Debtor Challenge to Debt Enforcement Order Following Settlement Agreement
Legislator-Zusammenfassung
KI-generiertIn a case involving a debt collection dispute, one party filed an opposition against an enforcement order for the collection of a specific monetary amount, citing their failure to return to better fortune as the reason. Subsequently, the parties reached a settlement agreement in a hearing, which led to the removal of the case from the court's active list. However, the court later deemed the subsequent appeal against the dismissal of the case as inadmissible, stating that the issues raised were more appropriate for ordinary legal action rather than the appeal process. The appealing party expressed willingness to withdraw while keeping the option to pursue the case if a fee waiver was available, but this request for judicial assistance was ultimately rejected due to the lack of significant legal basis. The case was subsequently stricken from the court's active list, with judicial costs assigned to the appealing party.

Decreto del 5 agosto 2010
II Corte di diritto civile
Composizione
Giudice federale Hohl, Presidente,

A.________,
ricorrente,
contro
B.________SA,
opponente.
Oggetto
accertamento di non ritorno a migliore fortuna,
ricorso contro la sentenza emanata l'8 luglio 2010
dalla Camera di cassazione civile del Tribunale
d'appello del Cantone Ticino.
Visto:
che il 27 maggio 2010 B.________SA ha fatto notificare a A.________ un precetto esecutivo per l'incasso di fr. 1'388.65 al quale egli ha interposto opposizione, motivandola con il mancato ritorno a miglior fortuna;
che all'udienza svoltasi il 9 giugno 2010 dinanzi al Giudice di pace supplente del Circolo di Bellinzona le parti hanno raggiunto un accordo transattivo, in virtù del quale A.________ si è impegnato a pagare ratealmente il proprio debito;
che pertanto la lite è stata stralciata dai ruoli;
che con sentenza dell'8 luglio 2010 la Camera di cassazione civile del Tribunale d'appello del Cantone Ticino ha dichiarato irricevibile il ricorso inoltrato da A.________ contro il decreto di stralcio, siccome teso a invalidare la transazione giudiziale con argomenti (paura e confusione) che andrebbero semmai fatti valere nel quadro di un'azione ordinaria;
che contro questa sentenza A.________ è insorto dinanzi al Tribunale federale, il 28 luglio 2010, con un "ricorso civile";
che il 29 luglio 2010 egli è stato invitato a versare, entro un termine di dieci giorni, l'importo di fr. 300.-- a titolo di garanzia per le spese processuali presunte del ricorso;
considerando:
che con lettera del 30 luglio 2010 A.________ ha dichiarato di ritirare il ricorso, aggiungendo però di essere "disposto a continuare" qualora "ci fosse un procedimento senza [...] spese";
che qualora si volesse ravvedere in quest'affermazione una domanda tendente alla concessione dell'assistenza giudiziaria ai sensi dell' art. 64 LTF , la stessa andrebbe respinta, l'impugnativa del ricorrente - che può essere tenuta in considerazione solo quale ricorso sussidiario in materia costituzionale (art. 113 segg. LTF) dato l'esiguo valore di causa ( art. 74 cpv. 1 lett. b LTF ), e il tema della lite, non concernente una questione di diritto d'importanza fondamentale ( art. 74 cpv. 1 lett. b LTF ) - essendo manifestamente priva di possibilità di successo a causa della sua motivazione, non conforme ai requisiti posti dalla legge (116 seg. LTF);
che, pertanto, la possibilità di un "procedimento senza spese" è esclusa;
che in siffatte circostanze la causa può venire stralciata dai ruoli, conformemente a quanto previsto dall' art. 32 cpv. 2 LTF ;
che per le spese giudiziarie si rinvia all'art. 65 cpv. 1, cpv. 2 e cpv. 3 lett. b nonché all' art. 66 cpv. 1 LTF ;
per questi motivi, la Presidente decreta:
