Legislator-Zusammenfassung

KI-generiert

The case revolves around a legal dispute concerning the protection of the marital union between two parties. A lower court had declared the appeal concerning protective measures against one party to be inadmissible, prompting the other party to file a complaint with the Federal Tribunal. Despite requests for legal assistance, the applicant failed to pay the required advance fees for the appeal, leading the Federal Tribunal to ultimately deem the appeal inadmissible and not address the merits of the case.

Sentenza del 9 aprile 2010

II Corte di diritto civile

Composizione

Giudice federale Hohl, Presidente,

Cancelliere Piatti.

Partecipanti al procedimento

A.________,

ricorrente,

contro

B.________,

opponente.

Oggetto

protezione dell'unione coniugale,

ricorso contro la sentenza emanata il 7 gennaio 2010 dalla I Camera civile del Tribunale d'appello del

Cantone Ticino.

Considerando:

che con sentenza del 7 gennaio 2010 la I Camera civile del Tribunale di appello del Cantone Ticino ha dichiarato irricevibile un appello presentato da A.________ contro una decisione emanata dal Pretore del distretto di Lugano nella procedura di misure di protezione dell'unione coniugale incoata contro B.________;

che A.________ è insorta al Tribunale federale contro tale sentenza con ricorso del 2 febbraio 2010;

che con decreto dell'8 febbraio 2010 la Presidente della II Corte di diritto civile ha respinto, per carenza di possibilità di esito favorevole del gravame, la domanda di assistenza giudiziaria della ricorrente;

che con decreto del 12 febbraio 2010 la ricorrente è stata invano invitata a versare un anticipo spese di fr. 1000.--;

che con decreto dell'8 marzo 2010 alla ricorrente è stato concesso un termine suppletorio di 10 giorni dalla ricezione del decreto per provvedere al versamento del predetto anticipo;

che non avendo la ricorrente ritirato l'atto giudiziario contenente l'appena menzionato decreto la sua notifica è reputata avvenuta il 17 marzo 2010 ( art. 44 cpv. 2 LTF );

che le misure di protezione dell'unione coniugale sono considerate misure provvisionali ai sensi degli art. 46 cpv. 2 e 98 LTF ( DTF 133 III 393 consid. 5.2, 585 consid. 3.3), motivo per cui l'assegnato termine non è sospeso dalle ferie giudiziarie pasquali;

che con scritto pervenuto al Tribunale federale il 10 marzo 2010 la ricorrente, riferendosi alla decisione sulla domanda di assistenza giudiziaria, ha domandato "la sospensione della sentenza";

che tale richiesta, intesa come una domanda di riconsiderazione del decreto dell'8 febbraio 2010, va respinta, la ricorrente non adducendo alcun motivo a sua giustificazione;

che il 7 aprile 2010 la cassa del Tribunale federale ha constatato che il richiesto anticipo spese non è stato pagato né accreditato sul suo conto postale e che non le è pervenuto alcun avviso di addebito di un conto bancario o postale;

che in queste circostanze il Tribunale federale non può entrare nel merito del ricorso (art. 48 cpv. 4 e 62 cpv. 3 LTF);

che giusta l' art. 108 cpv. 1 lett. a LTF il Presidente della Corte decide in procedura semplificata i ricorsi manifestamente inammissibili;

che le spese giudiziarie seguono la soccombenza ( art. 66 cpv. 1 LTF );

per questi motivi, la Presidente pronuncia:

Hohl Piatti
