Swiss Federal Tribunal Rejects Appeal on Debt Removal Due to Lack of Justification
Legislator-Zusammenfassung
KI-generiertThe case involves a dispute between two parties concerning the definitive lifting of an opposition to a payment order. The respondent was seeking to enforce a claim totaling 55,866.65, based on two enforceable cantonal judgments, while the opposing party contested the legitimacy of the claim, asserting they had settled their obligations. However, the opposing party failed to substantiate their claims sufficiently in their appeal to the Federal Court, which led to the appeal being declared inadmissible. Consequently, the court ordered the appellant to bear the legal costs associated with the proceedings.

Objet
mainlevée définitive de l'opposition,
recours contre l'arrêt de la Cour des poursuites et faillites du Tribunal cantonal du canton de Vaud du 2 octobre 2008.
Considérant:
que l'arrêt attaqué prononce, à concurrence de 55'866 fr. 65 plus intérêts, la mainlevée définitive de l'opposition formée par X.________ au commandement de payer n° xxxx de l'Office des poursuites de Lausanne-Est, notifié à la réquisition de Y.________;
qu'il retient en substance que les montants en poursuite se fondent sur deux jugements cantonaux exécutoires, que le poursuivi n'a pas établi sa libération ( art. 81 al. 1 LP ) et que c'est en vain qu'il met en cause l'existence matérielle de la créance;
que dans son recours au Tribunal fédéral le poursuivi ne s'en prend nullement aux considérants de la cour cantonale et ne démontre donc pas en quoi la décision de cette autorité serait contraire au droit ou à la Constitution;
qu'ainsi, faute de contenir une motivation répondant aux exigences des art. 42 al. 2 et 106 al. 2 LTF, le recours doit être déclaré irrecevable en procédure simplifiée selon l' art. 108 al. 1 let. b LTF , aux frais de son auteur ( art. 66 al. 1 LTF );
par ces motifs, vu l' art. 108 al. 1 LTF , la Présidente prononce:
1. Le recours est irrecevable.
2. Les frais judiciaires, arrêtés à 1'200 fr., sont mis à la charge du recourant.
3. Le présent arrêt est communiqué aux parties et à la Cour des poursuites et faillites du Tribunal cantonal du canton de Vaud.
