In this case, a co-owner of a property contested a decision regarding the dissolution of joint ownership through a public auction, which was set with a minimum bid of 28,620,000 CHF. Following an appeal against a prior ruling, the appellate court ordered the appellant to pay a deposit of 10,000 CHF as a guarantee for potential legal costs. The appellant then sought to lower this required deposit to a maximum of 2,000 CHF through a recourse to a higher court. The response from the higher court considered whether the appellant faced irreparable harm due to the financial obligation imposed, ultimately determining the appeal to be inadmissible based on the appellant's financial capability to meet the required deposit.

Sentenza del 22 novembre 2017

II Corte di diritto civile

Composizione

Giudice federale von Werdt, Presidente,

Cancelliera Antonini.

Partecipanti al procedimento

A.________,

patrocinato dall'avv. dott. Gianmaria Bianchetti,

ricorrente,

contro

Considerando:

che con appello 4 ottobre 2017 A.________, comproprietario del fondo n. 1159 RFD di X.________ in ragione di ¼, ha contestato la decisione emessa il 31 agosto 2017 dal Pretore del Distretto di Lugano pronunciante lo scioglimento della comproprietà costituita sul predetto mappale mediante licitazione pubblica con base d'asta minima pari a fr. 28'620'000.--;

che con decisione 2 novembre 2017 il Presidente della I Camera civile del Tribunale d'appello del Cantone Ticino ha invitato l'appellante a versare un anticipo di fr. 10'000.-- entro il 20 novembre 2017 in garanzia delle spese processuali presumibili;

che con ricorso 16 novembre 2017 A.________ ha impugnato tale decisione dinanzi al Tribunale federale, chiedendo di fissare l'anticipo " nell'importo massimo di Fr. 2'000.-- ";

che la decisione con cui viene chiesto un anticipo a copertura delle spese processuali presumibili costituisce una decisione incidentale che può essere immediatamente impugnata al Tribunale federale soltanto se può causare un pregiudizio irreparabile ( art. 93 cpv. 1 lett. a LTF ), ossia un pregiudizio di natura giuridica ( DTF 142 III 798 consid. 2.1 e 2.2);

che non incorre in un tale pregiudizio colui che possiede i mezzi finanziari per pagare il richiesto anticipo ( DTF 142 III 798 consid. 2.3.4);

che a questo proposito il ricorrente si limita ad affermare di essere al beneficio di una rendita di invalidità di fr. 1'984.-- mensili, ma non pretende di non essere in grado di versare l'anticipo né tantomeno lo dimostra;

che in tali circostanze il ricorso, manifestamente inammissibile, può essere deciso nella procedura semplificata dell' art. 108 cpv. 1 lett. a LTF ;

che le spese giudiziarie seguono la soccombenza ( art. 66 cpv. 1 LTF );

per questi motivi, il Presidente pronuncia:

1. Il ricorso è inammissibile.
