In this case, a party appealed a decision made by the Civil Court of the Valais canton, which rejected a request for additional evidence related to an ongoing appeal concerning a divorce judgment. The court determined that the existing evidence was sufficient to address contentious issues like custody and the need for guardianship. The Federal Tribunal deemed the appeal manifestly inadmissible because it was directed against an interim decision that did not cause irreparable harm to the appellant, thereby preserving the appellant's opportunity to raise concerns in a later appeal following the final judgment. Judicial costs associated with the appeal were assigned to the appellant.

Objet

Requête en complément d'instruction,

recours contre la décision du Tribunal cantonal du canton du Valais du 9 novembre 2012.

Considérant:

que, par ordonnance du 9 novembre 2012, le Président de la Cour civile II du Tribunal cantonal du canton du Valais a rejeté la requête en complément d'instruction déposée par le recourant dans le cadre d'une procédure d'appel contre un jugement de divorce;

que la décision querellée retient, par appréciation anticipée des preuves, que les moyens de preuve existants étaient suffisants pour statuer sur les questions litigieuses que sont l'attribution de l'autorité parentale et la nécessité d'instaurer une curatelle;

que le recours immédiat au Tribunal fédéral est en l'espèce manifestement irrecevable ( art. 108 al. 1 let. a LTF ) dès lors qu'il est dirigé contre une décision incidente qui n'est pas susceptible de causer un dommage irréparable au recourant ( art. 93 al. 1 let. a LTF ), lequel gardera la possibilité de soulever ses griefs dans un futur recours contre l'arrêt final, et que l'hypothèse aménagée par l' art. 93 al. 1 let. b LTF est a priori exclue;

que le recourant a au demeurant été rendu attentif à la problématique de la recevabilité par courrier du Président de la Cour civile II;

que les frais judiciaires sont mis à la charge de l'intéressé ( art. 66 al. 1 LTF );

par ces motifs, la Présidente prononce:

1. Le recours est irrecevable.
