Appeal in Divorce Proceedings Dismissed for Non-Compliance with Formal Appeal Requirements The case involved an appeal against a cantonal court decision, which had declared an appeal in a divorce proceeding inadmissible due to non-compliance with formal requirements, specifically Article 311 para. 1 CPC. The appellant had failed to provide specific legal conclusions and sufficient reasoning for their appeal, instead offering only a vague request that their proposals be "taken into account or at least discussed," and failed to criticize the ratifications of partial conventions on the effects of the divorce. The Federal Supreme Court confirmed the dismissal of the appeal, finding that the appellant's submission did not address the reason for the inadmissibility—the deficient motivation and lack of specific conclusions under Article 311 para. 1 CPC—but instead focused exclusively on the substance of the dispute, rendering the appeal to the Federal Supreme Court itself irreceivable.

Arrêt du 20 janvier 2025

IIe Cour de droit civil

Composition

M. le Juge fédéral Bovey, Président.

Greffier : M. Braconi.

Participants à la procédure

A.A.________,

recourant,

*contre*

B.A.________,

représentée par Me Alexa Landert, avocate, intimée.

Objet

divorce,

4.2.
