The Swiss Federal Tribunal declared the debtor’s appeal inadmissible and upheld the lower court’s bankruptcy order, meaning the bankruptcy remains in force. The debtor had challenged a cantonal appellate decision that affirmed the opening of bankruptcy proceedings initiated by a creditor. The debtor argued that, after the appeal decision, she had paid all debts and therefore satisfied the conditions for revoking the bankruptcy under Art. 174 para. 2 of the Swiss Debt Enforcement and Bankruptcy Act (LEF). The Court rejected the appeal because it contained no criticism of the challenged ruling and relied solely on a new fact (the alleged payment) that occurred after the cantonal judgment, which is inadmissible as a novum. The Court also noted the debtor failed to show payment at the time of the cantonal decision, deposit of the owed amount with the court, or withdrawal of the creditor’s request, as required by Art. 174 para. 2 LEF. Procedurally, the appeal failed to meet the strict reasoning requirements of Art. 42 para. 2 and Art. 106 para. 2 LTF. Court costs of CHF 1,000 were imposed on the debtor.

Sentenza del 6 gennaio 2009

II Corte di diritto civile

Composizione

Giudice federale Hohl, Presidente,

Cancelliere Piatti.

Parti

A.________,

ricorrente,

contro

B.________,

opponente.

Oggetto

fallimento,

ricorso contro la sentenza emanata il 10 novembre 2008 della Camera di esecuzione e fallimenti del Tribunale d'appello del Cantone Ticino.

Considerando:

che in accoglimento dell'istanza presentata da B.________, il 29 settembre 2008 il Pretore della giurisdizione di Locarno-Città ha pronunciato il fallimento della A.________;

che la Camera di esecuzione e fallimenti del Tribunale d'appello del Cantone Ticino ha respinto un ricorso della A.________ e ha nuovamente pronunciato il fallimento a far tempo da mercoledì 12 novembre 2008;

che in virtù della sentenza cantonale l'insorgente non ha provato di aver estinto l'esecuzione contro di lei promossa da B.________ ( art. 174 cpv. 2 n. 1 LEF ), né di aver depositato presso l'autorità giudiziaria superiore l'importo dovuto a disposizione della creditrice ( art. 174 cpv. 2 n. 2 LEF ), né risulta il ritiro della domanda di fallimento da parte di quest'ultima ( art. 174 cpv. 2 n. 3 LEF );

che con ricorso in materia civile del 10 dicembre 2008 la fallita afferma di aver provveduto dopo la sentenza d'appello "a saldare tutti i debiti presso l'UEF di Locarno" e di non avere "più nessun debito e nessuna fattura scoperta", e chiede al Tribunale federale di revocare il fallimento perché ritiene di aver adempiuto i presupposti di cui all' art. 174 cpv. 2 LEF ;

che giusta l' art. 42 cpv. 2 LTF nella motivazione del ricorso occorre spiegare perché l'atto impugnato viola il diritto e che in virtù dell' art. 106 cpv. 2 LTF il Tribunale federale esamina la violazione di diritti fondamentali e di disposizioni di diritto cantonale e intercantonale soltanto se il ricorrente ha sollevato e motivato tale censura;

che in concreto il ricorso non soddisfa i predetti requisiti di motivazione;

che infatti il gravame non contiene alcuna critica rivolta contro la decisione impugnata, ma si fonda unicamente sull'inammissibile novum, siccome intervenuto dopo la pronuncia cantonale, del pagamento dei debiti;

che pertanto il ricorso si rivela inammissibile e può essere deciso dal Presidente della Corte nella procedura semplificata ( art. 108 cpv. 1 lett. b LTF );

che le spese giudiziarie seguono la soccombenza ( art. 66 cpv. 1 LTF );

per questi motivi, il Presidente pronuncia:

1. Il ricorso è inammissibile.

2. Le spese giudiziarie di fr. 1000.-- sono poste a carico della ricorrente.

3. Comunicazione alle parti e alla Camera di esecuzione e fallimenti del Tribunale d'appello del Cantone Ticino.
