Legislator-Zusammenfassung

KI-generiert

The case involves a divorce proceeding where one spouse has filed an appeal against a decision made by the civil court of a canton. The higher court noted that a recusal procedure initiated by the appellant was rendered moot and ordered its classification. Additionally, the court found other submissions by the appellant to be inadmissible, citing their complexity and lack of relevance to the court's competence. The appellant's appeal lacked clarity and did not effectively demonstrate any legal or constitutional violations in the lower court's ruling. Consequently, both the appeal and a request for legal aid were rejected, placing the judicial costs on the appellant.

Arrêt du 24 novembre 2010

IIe Cour de droit civil

Composition

Mme la Juge Hohl, Présidente.

Greffier: M. Fellay.

Participants à la procédure

A.________, (époux),

recourant,

contre

dame A.________, (épouse),

représentée par Me Pierre Bauer, avocat,

intimée.

Objet

divorce,

recours contre l'arrêt de la Cour de cassation civile

du Tribunal cantonal du canton de Neuchâtel

du 21 octobre 2010.

Vu:

l'acte de recours du 18 novembre 2010;

la demande d'assistance judiciaire du 19 novembre 2010;

considérant:

que l'arrêt attaqué constate qu'une procédure de récusation engagée par le recourant est devenue sans objet et en ordonne en conséquence le classement;

qu'il déclare pour le surplus irrecevables des écritures de sa part, jugées touffues, confuses et formulant des requêtes ne relevant pas de la compétence de la cour cantonale;

que dans son mémoire au Tribunal fédéral le recourant ne s'en prend pas, de manière compréhensible, aux considérants de la cour cantonale et ne démontre donc pas en quoi la décision de cette autorité serait contraire au droit ou à la Constitution;

qu'ainsi, faute de contenir une motivation répondant aux exigences des art. 42 al. 2 et 106 al. 2 LTF, le recours doit être déclaré irrecevable en procédure simplifiée selon l' art. 108 al. 1 let. b LTF ;

que la demande d'assistance judiciaire doit être rejetée faute de chances de succès du recours ( art. 64 al. 1 LTF );

qu'en conséquence, les frais de la présente procédure sont mis à la charge du recourant ( art. 66 al. 1 LTF );

par ces motifs, la Présidente prononce:

1. Le recours est irrecevable.
