Debt collection appeal inadmissible for lack of reasoning under Article 42 LTF.
Legislator-Zusammenfassung
KI-generiertThe Swiss Federal Supreme Court declared the appeal inadmissible, ruling against the appellant and ordering it to pay court costs of 1,200 Swiss francs. The case concerned a challenge to a lower court’s decision (Cantonal Court of Vaud, dated 7 October 2008) in a debt collection matter involving the definitive lifting of an opposition (mainlevée définitive de l'opposition). The appeal was dismissed because, although filed within the statutory deadline under Article 100(1) of the Federal Supreme Court Act (LTF), it lacked any substantive legal reasoning as required by Article 42 LTF. The deadline for filing a supplementary memorandum had expired and could not be extended under Article 47(1) LTF, so the court rejected the request for additional time and disposed of the case under the simplified procedure of Article 108(1) LTF. The lower court’s decision therefore remains in force.

recours contre l'arrêt de la Cour des poursuites
et faillites du Tribunal cantonal du canton de Vaud
du 7 octobre 2008.
Considérant:
qu'un recours au Tribunal fédéral doit être déposé dans le délai ( art. 100 al. 1 LTF ) et la forme ( art. 42 LTF ) prévus par la loi;
qu'en l'espèce, le recours a certes été déposé dans le délai légal, mais il ne contient aucune motivation;
que le délai de l' art. 100 al. 1 LTF étant échu et ne pouvant être prolongé ( art. 47 al. 1 LTF ), il n'y a pas lieu de fixer au recourant, comme il le demande, un délai pour présenter un mémoire complémentaire;
que le recours doit par conséquent être déclaré irrecevable en procédure simplifiée ( art. 108 al. 1 LTF ), aux frais de son auteur ( art. 66 al. 1 LTF );
par ces motifs, le Président prononce:
1. Le recours est irrecevable.
2. Les frais judiciaires, arrêtés à 1'200 fr., sont mis à la charge du recourant.
3. Le présent arrêt est communiqué aux parties et à la Cour des poursuites et faillites du Tribunal cantonal du canton de Vaud.
