Withdrawal of appeal for denial of justice in debt enforcement supervisory proceedings
Legislator-Zusammenfassung
KI-generiertThe Swiss Federal Supreme Court struck the case from the docket as moot after the appellants withdrew their appeal, ordering them to bear the court costs of CHF 300 jointly and severally. The appellants had filed a public-law appeal (under Articles 72 ff. of the Federal Supreme Court Act) for denial of justice and undue delay against a decision of the Cantonal Court Committee of Grisons, which acted as supervisory authority over debt enforcement and bankruptcy. The withdrawal ended the proceedings, so the challenged cantonal decision remains in force. Legal basis: Article 32(2) (president’s ruling), Article 71 BGG in conjunction with Article 73 BZP (striking off upon withdrawal), and Articles 66(1) and (5) BGG (costs against the withdrawing parties).
