Legislator-Zusammenfassung

The Swiss Federal Tribunal (II Civil Law Court) took note of the appellant’s withdrawal of his civil law appeal and struck the case from the roll, thereby rejecting his request for legal aid and ordering him to pay court costs of CHF 1,000. The appeal had challenged a decision by the Neuchâtel Cantonal Administrative Court that dismissed proceedings concerning costs (dépens) in a guardianship and liability matter. Because the appellant withdrew after the judge had completed his report and the case was ready for circulation, the court applied Articles 71 and 32(2) LTF, along with Articles 73 and 5(2) PCF by reference, to dismiss the legal aid request and allocate the judicial fee to the appellant, with no costs awarded to either party.
