Legislator-Zusammenfassung

KI-generiert

The case involves a civil appeal related to an inheritance division, where the appellant was ordered to pay a significant sum to the estate. The President of the Civil Chamber of the Cantonal Court rejected a request for suspensive effect on the payment, leading the appellant to appeal this decision at the Federal Tribunal. The appellant contended that the obligation to pay was excessive, especially while the case was pending. However, the Tribunal found that the grounds for the appeal did not adequately demonstrate a violation of constitutional rights, resulting in the dismissal of the appeal as inadmissible.

Oggetto

effetto sospensivo (divisione ereditaria),

ricorso contro il decreto emanato il 13 agosto 2010

dal Presidente della I Camera civile del Tribunale di appello del Cantone Ticino.

Considerando:

che nell'ambito della divisione ereditaria fu I.________, A.________ è stato segnatamente condannato a versare alla relativa Comunione ereditaria fr. 250'000.--, oltre interessi al 5 % dal 23 maggio 1990;

che A.________ ha impugnato la decisione pretorile alla I Camera civile del Tribunale d'appello del Cantone Ticino e che il 24 luglio 2010 il Presidente di tale Camera ha respinto una domanda di effetto sospensivo con cui l'appellante chiedeva di non dover versare il predetto importo in pendenza di causa;

che il 13 agosto 2010 il Presidente della I Camera civile del Tribunale d'appello ha respinto una domanda di riconsiderazione del decreto emanato il 24 luglio 2010, ribadendo che in concreto l'obbligo di pagamento pendente causa appare oneroso ed impegnativo, ma non tale da mettere l'appellante in gravi difficoltà finanziarie;

che A.________ è insorto al Tribunale federale con un ricorso in materia civile del 30 agosto 2010, con cui postula l'annullamento del decreto presidenziale del 13 agosto 2010 e la concessione dell'effetto sospensivo ai suoi appelli;

che le decisioni relative alla concessione dell'effetto sospensivo sono considerate di natura cautelare ( DTF 134 II 192 consid. 1.5), motivo per cui il ricorrente può unicamente far valere la violazione di diritti costituzionali ( art. 98 LTF );

che in virtù dell' art. 42 cpv. 2 LTF nei motivi del ricorso occorre spiegare in modo conciso perché l'atto impugnato viola il diritto e che giusta l' art. 106 cpv. 2 LTF il Tribunale federale esamina la violazione di diritti fondamentali e costituzionali ( DTF 133 III 638 consid. 2 pag. 640) soltanto se il ricorrente ha sollevato e motivato tale censura;

che in concreto il gravame non rispetta i predetti requisiti di motivazione, il ricorrente non prevalendosi di alcuna violazione di diritti costituzionali;

che pertanto il ricorso si rivela inammissibile e può essere deciso dalla Presidente della Corte nella procedura semplificata ( art. 108 cpv. 1 lett. b LTF );

che le spese giudiziarie seguono la soccombenza ( art. 66 cpv. 1 LTF );

per questi motivi, la Presidente pronuncia:

1. Il ricorso è inammissibile.
