A Swiss company faced bankruptcy proceedings initiated by another company, leading to a ruling on May 26, 2021, by the Head of District of Lugano that declared the company bankrupt effective May 27, 2021. The Swiss company attempted to appeal this decision by submitting a request for a suspension of the bankruptcy effect but was rejected by the Court of Execution and Bankruptcy of the Ticino Appeal Court on June 21, 2021. Despite the company's intention to credit a substantial amount towards the debts, the court found that payment was not credited within the necessary timeframe, thus not meeting the conditions for annulment of bankruptcy as per Swiss debt enforcement law. The Swiss company subsequently filed an appeal with the Federal Tribunal on July 21, 2021, arguing that a minor delay in payment should not justify declaring the bankruptcy unappealable and criticizing the rejection of the suspension request as excessively formalistic. However, the tribunal found the appeal insufficiently motivated regarding alleged constitutional rights violations, relevant to the court's previous justification, and could preclude the possibility of success of the appeal.

Oggetto

effetto sospensivo (fallimento),

Ritenuto in fatto e considerando in diritto:

Conformemente all' art. 106 cpv.

174 cpv. 2 LEF
