Legislator-Zusammenfassung

KI-generiert

The Swiss Federal Supreme Court declared the appellant's civil appeal inadmissible, affirming the lower cantonal court's decision that dismissed the appellant's challenge to a seizure order; consequently, the earlier rulings rejecting the opposition to the seizure and confirming the seizure remain in force. The dispute arose from a procedural ruling where the cantonal court deemed the appellant's appeal untimely and non-compliant because the appellant failed to pay the required advance on costs within the deadline and did not validly request an extension, as the request was made by his former counsel after the mandate had ended. Deciding under Article 98 of the Federal Supreme Court Act, the Court held that the appeal raised no constitutional rights violations, and due to this lack of adequate constitutional-law reasoning as required by Article 106(2) of the same Act, the appeal was inadmissible; the Court ordered the appellant to bear judicial costs of 700 Swiss francs.

Objet

opposition au séquestre,

recours contre l'arrêt de la Cour des poursuites et faillites du Tribunal cantonal du canton de Vaud du 5 août 2011.

Considérant:

que, par arrêt du 5 août 2011, la Cour des poursuites et faillites du Tribunal cantonal vaudois a déclaré irrecevable le recours interjeté par le recourant contre la décision, rendue le 16 décembre 2010 par le Juge de paix du district de Lausanne, par laquelle cette autorité rejetait l'opposition qu'il avait formée au séquestre obtenu par l'intimé et confirmait l'ordonnance de séquestre du 6 octobre 2010;

que le Tribunal cantonal a relevé que le recourant s'était vu fixer un délai au 3 juin 2011 pour payer l'avance de frais de 900 fr., que son avocat, par courrier du 20 mai 2011, avait informé la juridiction de la fin de son mandat, puis, par courrier du 3 juin 2011, avait requis "à toutes fins utiles" une prolongation du délai pour payer l'avance de frais;

que les juges cantonaux ont noté que le recourant n'avait pas versé l'avance de frais requise dans le délai imparti, ni sollicité la prolongation de ce délai, la requête de prolongation du 3 juin 2011 adressée par son ancien mandataire ne pouvant être prise en considération en tant qu'il ne disposait plus d'aucun pouvoir de représentation;

que le recours en matière civile ne contient aucun grief de violation de droits constitutionnels, seuls griefs ouverts dans le cadre de la présente affaire concernant l'opposition au séquestre ( art. 98 LTF ; ATF 135 III 232 consid. 1.2; FABIENNE HOHL, Procédure civile, tome 2, 2e éd. 2010, n. 3073);

que, faute de motivation satisfaisant aux exigences de l' art. 106 al. 2 LTF , le recours doit en conséquence être déclaré irrecevable selon la procédure simplifiée prévue à l' art. 108 al. 1 let. b LTF ;

que les frais judiciaires doivent être mis à la charge du recourant ( art. 66 al. 1 LTF );

par ces motifs, la Présidente prononce:

1. Le recours est irrecevable.
