Inadmissibility Due to Failure to Pay Appeal Costs
Legislator-Zusammenfassung
KI-generiertIn this case, a company faced enforcement proceedings initiated by a bank for the collection of a claim amounting to CHF 300,000 along with accrued interest. The initial opposition to the bank’s order was rejected by a local court. Subsequently, the appellate court upheld this decision, leading the company to appeal to the Swiss Federal Tribunal. However, the Tribunal required an advance cost payment, which the company failed to provide within the designated timeframe. Consequently, the Tribunal determined that it could not consider the appeal due to its inadmissibility based on this failure to pay, leading to a decision against the company concerning the court costs.

Partecipanti al procedimento
A.________AG,
ricorrente,
contro
banca B.________SA,
opponente.
Oggetto
esecuzione cambiaria,
ricorso contro la sentenza emanata il 21 giugno 2016 dalla Camera di esecuzione e fallimenti del Tribunale d'appello del Cantone Ticino.
Considerando:
che nell'esecuzione cambiaria promossa dalla banca B.________SA nei confronti di A.________AG per l'incasso di fr. 300'000.-- oltre interessi, con decisione 13 aprile 2016 il Pretore aggiunto della Giurisdizione di Mendrisio-Sud ha rigettato l'opposizione interposta dall'escussa al precetto esecutivo;
che con sentenza 21 giugno 2016 la Camera di esecuzione e fallimenti del Tribunale d'appello del Cantone Ticino ha respinto, nella misura della sua ammissibilità, il reclamo presentato da A.________AG contro la decisione pretorile;
che con ricorso 29 luglio 2016 A.________AG ha impugnato la sentenza cantonale dinanzi al Tribunale federale;
che con decreto 2 agosto 2016 la ricorrente è stata invano invitata a versare un anticipo spese di fr. 5'000.--;
che con decreto 31 agosto 2016 a A.________AG è stato concesso un termine suppletorio non prorogabile di dieci giorni (dalla notifica del decreto) per provvedere al versamento di tale anticipo spese;
che quest'ultimo decreto è stato notificato alla ricorrente in data 8 settembre 2016, per cui il termine suppletorio di dieci giorni è scaduto lunedì 19 settembre 2016 ( art. 45 cpv. 1 LTF );
che il 30 settembre 2016 la cassa del Tribunale federale ha constatato che il richiesto anticipo spese non è stato pagato né accreditato sul suo conto postale e che non le è pervenuto alcun avviso di addebito di un conto bancario o postale;
che in queste circostanze il Tribunale federale non può entrare nel merito del ricorso (art. 48 cpv. 4 e 62 cpv. 3 LTF);
che pertanto il ricorso si rivela manifestamente inammissibile e può essere deciso nella procedura semplificata dell' art. 108 cpv. 1 lett. a LTF ;
che le spese giudiziarie seguono la soccombenza ( art. 66 cpv. 1 LTF );
per questi motivi, il Presidente pronuncia:
1. Il ricorso è inammissibile.
2. Le spese giudiziarie di fr. 300.-- sono poste a carico della ricorrente.
3. Comunicazione alle parti e alla Camera di esecuzione e fallimenti del Tribunale d'appello del Cantone Ticino.
