The case involves a dispute regarding a garnishment notice issued by an enforcement office against two individuals. The enforcement office issued the garnishment on April 16, 2008, in connection with legal actions taken against them. Subsequently, a regional court upheld the garnishment, dismissing their appeal on the grounds that certain objections they raised were jurisdictional issues that should have been addressed by a judge in a related proceeding. In their appeal to the Supreme Court, the individuals contested the basis of the garnishment, arguing that the underlying contract should have been established in the name of a company they were involved with, rather than under their individual names. However, the Supreme Court found the appeal to be inadmissible due to insufficient argumentation regarding the legal violations they claimed had occurred.

Sentenza del 19 settembre 2008

II Corte di diritto civile

Composizione

Giudice federale Raselli, Presidente.

Cancelliere Piatti.

Parti

A e B X.________,

ricorrenti,

contro

Ufficio di esecuzione di Lugano, Via Bossi 2a, 6900 Lugano,

opponente.

Oggetto

Pignoramento,

ricorso contro la decisione emanata l'11 agosto 2008 dalla Camera di esecuzione e fallimenti del Tribunale d'appello del Cantone Ticino.

Considerando:

che il 16 aprile 2008 l'ufficio di esecuzione di Lugano ha emesso gli avvisi di pignoramento nell'ambito delle esecuzioni promosse nei confronti di A e B X.________;

che con sentenza 11 agosto 2008 la Camera di esecuzione e fallimenti del Tribunale d'appello del Cantone Ticino, quale autorità di vigilanza, ha respinto un ricorso degli escussi contro i predetti provvedimenti;

che l'autorità di vigilanza ha ritenuto improponibile, perché riguardante una questione di merito che doveva essere sottoposta al giudice del rigetto dell'opposizione, la contestazione inerente al contratto su cui il creditore ha fondato le esecuzioni;

che con ricorso in materia civile del 27 agosto 2008 A e B X.________ chiedono al Tribunale federale di annullare "i precetti e successivi pignoramenti";

che nel loro rimedio i ricorrenti si limitano in sostanza ad asserire che il contratto su cui si fonda l'esecuzione avrebbe dovuto essere steso a nome di una loro società e di non più usufruire dell'ente locato;

che giusta l' art. 42 cpv. 2 LTF nella motivazione del ricorso occorre spiegare perché l'atto impugnato viola il diritto e che in virtù dell' art. 106 cpv. 2 LTF il Tribunale federale esamina la violazione di diritti fondamentali e di disposizioni di diritto cantonale e intercantonale soltanto se il ricorrente ha sollevato e motivato tale censura;

che il rimedio non contiene un'argomentazione in rapporto con la sentenza impugnata e non soddisfa quindi i menzionati requisiti di motivazione, i ricorrenti omettendo segnatamente di spiegare per quale motivo l'autorità inferiore avrebbe violato il diritto ritenendo la critica ricorsuale sottratta alla sua cognizione;

che pertanto il ricorso, manifestamente inammissibile, può essere deciso nella procedura semplificata dell' art. 108 cpv. 1 lett. b LTF ;

che le spese giudiziarie seguono la soccombenza ( art. 66 cpv. 1 LTF );

per questi motivi, il Presidente pronuncia:

1. Il ricorso è inammissibile.

2. Le spese giudiziarie di fr. 500.-- sono poste a carico dei ricorrenti in solido.

3. Comunicazione alle parti e alla Camera di esecuzione e fallimenti del Tribunale d'appello del Cantone Ticino.
