The case involves an appellant challenging a decision regarding the appointment of an administrator for an inheritance. In the context of an appeal against a prior ruling, the appellate court required the appellant to pay an advance on court fees. After a series of deadlines and requests for extensions were rejected, the appellate court noted that the payment had not been made and issued an ultimatum for proof of payment. The appellant subsequently filed a complaint to reduce the required advance, which was then referred to the federal court for further consideration. The proceedings highlighted the issues of procedural requirements and the admissibility of appeals related to anticipated legal costs.

Art. 108 cpv. 1 lett. a LTF

The appeal was decided under the simplified procedure because it was manifestly inadmissible.

Art. 66 cpv. 1 LTF

The court costs of CHF 200 are imposed on the appellant based on the outcome of the case (loser pays).

Art. 93 cpv. 1 lett. a LTF

Cited in the reasoning to establish that the decision on the advance payment does not generally constitute an immediately appealable interlocutory decision unless irreparable harm is caused.

Sentenza del 17 luglio 2017

II Corte di diritto civile

Composizione

Giudice federale von Werdt, Presidente,

Cancelliera Antonini.

Partecipanti al procedimento

A.________,

ricorrente,

contro

Considerando:

che, nell'ambito dell'appello presentato da A.________ contro la decisione 4 febbraio 2016 con cui il Pretore della Giurisdizione di Locarno Campagna ha designato l'avv. B.________ in qualità di amministratrice dell'eredità fu C.________, in data 10 maggio 2017 il Presidente della I Camera civile del Tribunale d'appello del Cantone Ticino ha invitato l'appellante a versare entro il 12 giugno 2017 un anticipo di fr. 1'000.-- a copertura delle spese processuali presumibili ( art. 98 e 101 cpv. 1 CPC [RS 272]);

che una richiesta 28 maggio 2017 dell'appellante intesa a sospendere il termine per il versamento è stata respinta con decreto 7 giugno 2017;

che il 13 giugno 2017 all'appellante è stato fissato un ultimo termine improrogabile scadente il 26 giugno 2017 entro cui versare l'anticipo, con l'avvertenza che, decorso infruttuoso il termine, il Tribunale d'appello non sarebbe entrato nel merito del rimedio giuridico ( art. 101 cpv. 3 CPC );

che con decreto 27 giugno 2017, constatato che l'anticipo non risultava pagato, il Presidente della I Camera civile del Tribunale d'appello ha invitato l'appellante a documentare entro un termine di 10 giorni l'avvenuto versamento;

che con scritto 2 luglio 2017 A.________ ha indirizzato al Tribunale d'appello un " reclamo contro le decisioni in materia di anticipazione di 1.000 CHF ( art. 99, 103 CPC ) " (redatto in parte in italiano e in parte in francese), mediante il quale ha segnatamente chiesto " la riduzione dell'anticipazione a 200 CHF ";

che il 10 luglio 2017 il Tribunale d'appello ha tramesso al Tribunale federale tale scritto per competenza (v. art. 48 cpv. 3 LTF );

che infatti le decisioni in materia di anticipazione delle spese emanate in

seconda istanza non sono impugnabili mediante reclamo (v. art. 319 lett. b CPC ), ma unicamente mediante ricorso al Tribunale federale;

che la decisione con cui viene chiesto un anticipo a copertura delle spese processuali presumibili costituisce una decisione incidentale che può essere

immediatamente impugnata al Tribunale federale soltanto se può causare un pregiudizio irreparabile ( art. 93 cpv. 1 lett. a LTF ), ossia un pregiudizio di natura giuridica ( DTF 142 III 798 consid. 2.1 e 2.2);

che non incorre in un tale pregiudizio colui che possiede i mezzi finanziari per pagare il richiesto anticipo ( DTF 142 III 798 consid. 2.3.4);

che in concreto la ricorrente non pretende di non essere in grado di versare l'anticipo, per cui il suo gravame si rivela manifestamente inammissibile;

che in tali circostanze il ricorso può essere deciso (nella lingua della decisione impugnata, v. art. 54 cpv. 1 LTF ) nella procedura semplificata dell' art. 108 cpv. 1 lett. a LTF ;

che le spese giudiziarie seguono la soccombenza;

per questi motivi, il Presidente pronuncia:

1. Il ricorso è inammissibile.
