In this case, a civil appeal was filed against a provisional measures decision made by a lower court. The appellant sought to challenge a ruling issued on May 28, 2009, and subsequently initiated proceedings on August 7, 2009. During the appellate process, there were indications of ongoing negotiations between the parties, which ultimately led to the appellant's decision to withdraw the appeal. A procedural agreement was reached between the parties, confirming the withdrawal of the case from the court's docket. The tribunal noted the developments, including the late notification of the negotiations, and decided to formally acknowledge the withdrawal of the appeal and the associated judicial costs.

Ordonnance du 12 novembre 2009

IIe Cour de droit civil

Composition

Mme la Juge Hohl, Présidente.

Greffière: Mme de Poret.

Parties

X.________,

représenté par Me Grégoire Bovet, avocat,

recourant,

contre

dame X.________,

intimée.

Objet

mesures provisionnelles ( art. 137 CC ),

recours contre le jugement du Tribunal civil de l'arrondissement de la Sarine du 28 mai 2009.

Vu:

le recours en matière civile exercé le 7 août 2009 par X.________ contre le jugement rendu sur mesures provisionnelles le 28 mai 2009 par le Tribunal civil de l'arrondissement de la Sarine;

les ordonnances du 29 septembre 2009 impartissant à la partie intimée ainsi qu'à l'autorité cantonale un délai au 20 octobre 2009 pour se déterminer sur le recours;

la détermination de l'autorité cantonale du 30 septembre 2009;

la demande de prolongation de délai présentée par l'intimée le 20 octobre 2009, laquelle informe de l'existence de négociations entre les parties pouvant aboutir au retrait du recours;

l'ordonnance du 21 octobre 2009 octroyant à l'intimée une prolongation de délai au 10 novembre 2009;

le courrier du conseil de l'intimée du 9 novembre 2009 informant le Tribunal de céans de la résiliation de son mandat par sa cliente;

le courrier du conseil du recourant du 10 novembre 2009 faisant état d'une convention de procédure conclue entre les parties;

ladite convention de procédure par laquelle le recourant déclare notamment retirer le recours en matière civile déposé le 7 août 2009.

considérant:

qu'il y a lieu de prendre acte du retrait du recours et de rayer la cause rôle ( art. 73 PCF par renvoi de l' art. 71 LTF ; art. 32 al. 2 LTF );

que l'émolument judiciaire doit être fixé compte tenu de l'activité déployée jusqu'à ce jour par la cour de céans ( art. 65 LTF ) - qui n'a été informée de l'existence de pourparlers entre les parties que tardivement - et mis à la charge du recourant ( art. 5 al. 2 PCF par renvoi de l' art. 71 LTF ; art. 66 al. 1 LTF );
