Legislator-Zusammenfassung

KI-generiert

The case involves a divorce proceeding initiated unilaterally, where one party appealed to the Federal Tribunal after the Cantonal Court dismissed their appeal against an earlier decision made by a lower court. The appellant failed to address issues regarding their legal representation as required by federal law, resulting in an order to rectify this within a specified timeline, which was not honored. Consequently, the appeal was deemed manifestly inadmissible, leading to the dismissal of both the appeal and a request for legal assistance, while the appellant was also ordered to bear the court costs.

Sentenza del 16 luglio 2014

II Corte di diritto civile

Composizione

Giudice federale von Werdt, Presidente,

Cancelliera Antonini.

Partecipanti al procedimento

A.A.________,

ricorrente,

contro

B.A.________,

patrocinato dall'avv. Francesca Nicora,

opponente.

Oggetto

divorzio su richiesta unilaterale,

ricorso contro la sentenza emanata il 7 maggio 2014 dalla I Camera civile del Tribunale d'appello del

Cantone Ticino.

Considerando:

che con sentenza 7 maggio 2014 il Tribunale d'appello del Cantone Ticino ha respinto un appello presentato da A.A.________, confermando la sentenza 13 settembre 2012 pronunciata dal Pretore della giurisdizione di Locarno Campagna nella causa di divorzio che la oppone a B.A.________;

che A.A.________ è insorta al Tribunale federale contro la sentenza cantonale con ricorso 23 giugno 2014, redatto e firmato da C.________ Consulting;

che nelle cause civili sono ammessi come patrocinatori dinanzi al Tribunale federale soltanto gli avvocati che la legge federale del 23 giugno 2000 sulla libera circolazione degli avvocati (LLCA; RS 935.61) o un trattato internazionale autorizza a esercitare la rappresentanza in giudizio in Svizzera ( art. 40 cpv. 1 LTF );

che con decreto presidenziale 25 giugno 2014 la ricorrente è quindi stata invitata a firmare lei stessa il ricorso o a farlo firmare da un avvocato, nonché a rinviarlo al Tribunale federale entro un termine non prorogabile di dieci giorni dalla notifica del decreto, con la comminatoria che in caso d'inosservanza il ricorso non sarebbe stato preso in considerazione ( art. 42 cpv. 5 LTF );

che l'invio postale contenente tale decreto (spedito quale atto giudiziario all'indirizzo di C.________ Consulting) non è stato ritirato;

che il decreto, giunto all'ufficio postale di U.________ il 26 giugno 2014 e annunciato lo stesso giorno per il ritiro, deveessere considerato notificato il 3 luglio 2014 ( art. 44 cpv. 2 LTF );

che la ricorrente non ha sanato il vizio della rappresentanza nel termine impartitole, venuto a scadere lunedì 14 luglio 2014;

che in tali circostanze l'impugnativa si appalesa manifestamente inammissibile e può essere decisa nella procedura semplificata dell' art. 108 cpv. 1 lett. a LTF ;

che la domanda di assistenza giudiziaria della ricorrente è respinta per mancanza di probabilità di esito favorevole del ricorso ( art. 64 cpv. 1 e 3 LTF );

che le spese giudiziarie seguono la soccombenza ( art. 66 cpv. 1 LTF );

che non si giustifica assegnare ripetibili alla parte opponente;

per questi motivi, il Presidente pronuncia:

1. Il ricorso è inammissibile.
