The case involves a civil appeal concerning the responsibility of the state for the actions of a guardian. An individual filed for judicial assistance while pursuing a claim against another party. However, the individual later decided to withdraw the appeal, prompting the tribunal to acknowledge this withdrawal and remove the case from its agenda. As a result, the request for judicial assistance was denied, and the individual was ordered to bear the judicial costs incurred up to that point. The matter's complexity was highlighted by the involvement of legal representation for both parties.

intimé.

Objet

dépens (responsabilité de l'Etat pour les actes du tuteur),

recours contre la décision de la Cour de droit public

du Tribunal administratif du canton de Neuchâtel

du 21 décembre 2010.

Vu:

le recours en matière civile de A.________ du 20 janvier 2011, assorti d'une demande d'assistance judiciaire;

l'ordonnance présidentielle du 21 janvier 2011, différant la décision concernant l'assistance judiciaire;

la détermination de l'intimé du 2 février 2011;

la déclaration de retrait de A.________ du 22 novembre 2011, postée le lendemain;

considérant:

qu'il convient de prendre acte de ce retrait et de rayer la cause du rôle ( art. 73 PCF par renvoi de l' art. 71 LTF );

que le juge instructeur est compétent pour statuer à cet effet ( art. 32 al. 2 LTF );

que le recourant s'étant désisté, l'assistance judiciaire ne peut lui être octroyée et les frais doivent être mis à sa charge ( art. 5 al. 2 PCF par renvoi de l' art. 71 LTF ; art. 66 al. 1 et 2 LTF );

que l'émolument judiciaire doit être fixé en tenant compte de l'activité déployée jusqu'à ce jour par la Cour de céans ( art. 65 LTF );

que, en l'espèce, le retrait est intervenu avant que le juge instructeur ne se saisisse de l'affaire;

qu'il n'y a pas lieu d'allouer de dépens à l'intimé, qui s'en est remis, dans une courte lettre, à « la sagesse légendaire du Tribunal fédéral »;

par ces motifs, le Juge instructeur ordonne:
