Legislator-Zusammenfassung

KI-generiert

The Swiss Federal Court (II. Civil Law Division) struck the case from the record as moot, ordering the appellant to pay court costs of 300 CHF, after the appellant withdrew his appeal on August 10, 2009; the decision left the lower court's ruling (the cantonal high court's May 4, 2009 order denying legal recovery) in force. The dispute involved a challenge to a ruling on debt collection legal recovery (Rechtsöffnung), brought by the appellant against the respondents. The case was dismissed based on the appellant's withdrawal, with the court applying procedural rules on withdrawal (Art. 71 of the Federal Court Act, Art. 73 of the Federal Civil Procedure Act, Art. 32 para. 2, Art. 66 para. 1 of the Federal Court Act) to allocate costs to the withdrawing party.
