Legislator-Zusammenfassung

KI-generiert

In this case, an individual filed a legal challenge against a ruling by a lower court that declared a claim for the lifting of opposition to be inadmissible due to a lack of motivation. The lower court also noted that the creditor, in this instance represented by a governmental service, possessed a definitive title for the lifting of opposition. The individual's appeal to the Federal Tribunal did not sufficiently address the reasoning of the cantonal court's decision or demonstrate any legal or constitutional violations, leading to the conclusion that the appeal was inadmissible due to lack of proper motivation as required by relevant legal provisions. Consequently, no court fees were deemed necessary.

Arrêt du 4 juillet 2011

IIe Cour de droit civil

Composition

Mme la Juge Hohl, Présidente.

Greffier: M. Fellay.

Participants à la procédure

A.________,

recourant,

contre

Etat de Genève,

intimé.

Objet

mainlevée d'opposition,

recours contre l'arrêt de la Chambre civile de la Cour de justice du canton de Genève du 8 juin 2011.

Considérant:

que statuant sur un recours formé par A.________ contre un jugement du Tribunal de première instance du canton de Genève, l'arrêt attaqué le déclare irrecevable faute de motivation et au demeurant manifestement mal fondé, le jugement attaqué relevant de manière correcte que le créancier, soit l'Etat de Genève, Service des prestations complémentaires, est au bénéfice d'un titre de mainlevée définitive au sens de l' art. 80 LP ;

que dans son mémoire adressé au Tribunal fédéral, le recourant ne s'en prend nullement aux considérants de la cour cantonale et ne démontre donc pas en quoi la décision de cette autorité serait contraire au droit ou à la Constitution;

qu'ainsi, faute de contenir une motivation répondant aux exigences des art. 42 al. 2 et 106 al. 2 LTF, le recours doit être déclaré irrecevable en procédure simplifiée selon l' art. 108 al. 1 let. b LTF ;

qu'il peut être renoncé, en l'espèce, à la perception de frais judiciaires ( art. 66 al. 1, seconde phrase, LTF );

que la demande implicite d'assistance judiciaire est ainsi sans objet;

par ces motifs, la Présidente prononce:

1. Le recours est irrecevable.
