Bankruptcy without prior collections proceeding: voluntary withdrawal of appeal after suspensive-effect dispute, with costs and indemnity imposed on withdrawing appellant.
Legislator-Zusammenfassung
KI-generiertThe Swiss Federal Supreme Court struck the case from the roll after the appellant withdrew its appeal, ordering the appellant to pay court costs of 500 francs and 500 francs in costs to the respondent. The case concerned a challenge to a cantonal decision (Geneva) ordering bankruptcy without prior debt collection proceedings. The withdrawal ended the federal appeal, leaving the lower court's bankruptcy order in force. The legal basis was the appellant's voluntary withdrawal under Article 32(2) LTF and related cost provisions (Article 66(1) LTF for court fees and Article 68(1) LTF for prevailing-party costs, applied via Article 71 LTF).
