The case involves a party challenging a decision made by the Second Civil Chamber of the Court of Appeal in the canton of Bern, which declared a procedural matter moot and removed it from the docket. The party filed an appeal with the Federal Tribunal, seeking both the suspension of the proceeding and legal aid. However, the court found that the appeal did not meet the necessary criteria for suspension and deemed it inadmissible, as it lacked a coherent refutation of the lower court's reasoning. Consequently, the demands for suspension and legal assistance were rejected, and court fees were imposed on the party filing the appeal.

Arrêt du 30 juin 2008

IIe Cour de droit civil

Composition

M. le Juge Raselli, Président.

Greffier: M. Braconi.

Parties

F.________,

recourant,

contre

que, par ordonnance du 5 mai 2008, la 2ème Chambre civile de la Cour d'appel du canton de Berne a déclaré sans objet la procédure de prise à partie introduite par F.________ contre le Président 3 de l'arrondissement judiciaire I Courtelary-Moutier-La Neuveville, déclaré cette affaire liquidée et l'a rayée du rôle;

que le prénommé forme un recours au Tribunal fédéral à l'encontre de cette décision, en requérant la suspension de la procédure ainsi que l'octroi de l'assistance judiciaire et de l'effet suspensif;

que le recourant n'établit pas en quoi les conditions d'une suspension de la procédure seraient réalisées (cf. art. 6 PCF , applicable en vertu du renvoi de l' art. 71 LTF ), en sorte que la requête doit être rejetée;

que le recours, outre son caractère abusif ( art. 108 al. 1 let . c LTF), ne comporte aucune réfutation intelligible des motifs de la cour cantonale ( art. 42 al. 2 LTF , en relation avec l' art. 108 al. 1 let. b LTF );

que, cela étant, l'assistance judiciaire doit être refusée (art. 64 al. 1 et 3, 2ème phrase, LTF);

que le présent arrêt rend sans objet la requête d'effet suspensif;

que d'ultérieures écritures du même style, notamment des demandes abusives de révision, seront classées sans suite;

par ces motifs, le Président prononce:

1. La requête de suspension est rejetée.

2. Le recours est irrecevable.

3. La requête d'assistance judiciaire est rejetée.

4. Les frais judiciaires, arrêtés à 500 fr., sont mis à la charge du recourant.

5. Le présent arrêt est communiqué au recourant et à la 2ème Chambre civile de la Cour d'appel du canton de Berne.
