Inadmissibility of Appeal Due to Unpaid Cost Advance
Legislator-Zusammenfassung
KI-generiertThe case involves an individual challenging a bankruptcy ruling issued by a lower court, where the bankruptcy was requested by a company. The individual filed an appeal against this ruling at the Federal Tribunal after the lower court repeated the decision to declare bankruptcy in July 2007. Despite being instructed to pay an advance fee to process the appeal, the individual failed to do so within the specified timeframe, leading to the appeal being deemed inadmissible. The court noted that the notification regarding the payment obligation was considered received even though the individual did not collect it, and consequently, the appeal could not be reviewed on its merits.
