Legislator-Zusammenfassung

KI-generiert

The case involves a bankruptcy declaration made by a civil court, which was challenged by the applicant. The cantonal court ruled the appeal against the bankruptcy judgment as inadmissible, citing that the applicant's arguments were unclear and did not demonstrate a settlement or likelihood of solvency as required by law. Additionally, the applicant was unable to fulfill the conditions necessary for overturning the bankruptcy judgment despite being given the opportunity to do so. As a result, the higher court found the appeal to be incomprehensible, leading to its rejection and imposing court costs on the applicant.

Objet

prononcé de faillite,

recours contre l'arrêt du Tribunal cantonal de l'État de Fribourg, IIe Cour d'appel civil, du 4 mai 2012.

Considérant:

que, par arrêt du 4 mai 2012, la IIe Cour d'appel civil du Tribunal cantonal du canton de Fribourg a déclaré irrecevable le recours interjeté par le recourant contre un jugement du Président du Tribunal civil de la Sarine prononçant sa faillite le 19 mars 2012;

que l'arrêt cantonal retient que les griefs développés par le recourant dans ses écritures étaient difficilement compréhensibles et que l'intéressé n'établissait ni l'existence d'un règlement à l'amiable, ni la vraisemblance de sa solvabilité au sens de l' art. 174 LP , ce malgré l'invitation à compléter son recours et à établir les conditions requises pour l'annulation d'un jugement de faillite;

que les critiques formulées devant le Tribunal de céans sont incompréhensibles et ne satisfont ainsi nullement aux exigences posées par les art. 42 al. 2 et 106 al. 2 LTF;

que le présent recours doit en conséquence être déclaré irrecevable selon la procédure simplifiée prévue à l' art. 108 al. 1 let. b LTF ;

que les frais sont mis à la charge de la partie qui succombe ( art. 66 al. 1 LTF );

par ces motifs, la Présidente prononce:

1. Le recours est irrecevable.
