Legislator-Zusammenfassung

KI-generiert

The case involves a legal dispute in which an individual contested a decision regarding the lifting of a debt collection opposition, which had been ruled in favor of a company. The individual had requested a restoration of the payment deadline for the advance fees related to their appeal against this decision, citing a lack of liquidity as the reason for the delay. However, the court found this explanation unsubstantiated and indicated that the individual could have sought an extension of the deadline. In their appeal to the Federal Tribunal, the individual focused solely on disputing the validity of the debt itself, without addressing the reasoning of the lower court, leading to the appeal being declared inadmissible due to insufficient motivation.

Arrêt du 7 juin 2010

IIe Cour de droit civil

Composition

Mme la Juge Hohl, Présidente.

Greffier: M. Fellay.

Participants à la procédure

X.________,

recourant,

contre

Y.________ AG,

intimée.

Objet

mainlevée d'opposition,

recours contre l'arrêt de la Cour des poursuites et faillites du Tribunal cantonal du canton de Vaud du 20 avril 2010.

Considérant:

que l'arrêt attaqué écarte une requête de X.________ en restitution du délai de paiement de l'avance de frais pour le recours qu'il a interjeté contre un prononcé de mainlevée d'opposition rendu en faveur de l'intimée et qui a été déclaré non avenu faute d'avance de frais;

que la cour cantonale retient en substance que le manque de liquidités invoqué dans ladite requête - raison au demeurant non étayée - ne constitue pas un empêchement non fautif au sens de l' art. 33 al. 4 LP et que rien, apparemment, n'aurait empêché le recourant de demander une prolongation du délai imparti;

que dans son recours au Tribunal fédéral celui-ci se contente de contester le bien-fondé de la créance en poursuite, sans du tout s'en prendre aux considérants de la cour cantonale et tenter de démontrer en quoi la décision de cette autorité serait contraire au droit ou à la Constitution;

qu'ainsi, faute de contenir une motivation répondant aux exigences des art. 42 al. 2 et 106 al. 2 LTF, le recours doit être déclaré irrecevable en procédure simplifiée selon l' art. 108 al. 1 let. b LTF , aux frais de son auteur ( art. 66 al. 1 LTF );

par ces motifs, vu l' art. 108 al. 1 LTF , la Présidente prononce:

1. Le recours est irrecevable.
