The Swiss Federal Supreme Court struck the case 5A_347/2012 off the roll as moot because the appellants withdrew their appeal. The appellants—five parties jointly and severally liable—lost: they must pay court costs of CHF 500 and compensate the respondent CHF 500 for her statement on the stay application; the lower cantonal court decision (Kantonsgericht Freiburg, II. Zivilappellationshof, 3 April 2012) remains in force. The underlying dispute concerned a sequestration order (arrest) in aid of enforcing a foreign judgment. The appeal was brought under Articles 72 et seq. of the Federal Supreme Court Act (BGG); the withdrawal was processed under Article 32(2) BGG, Article 71 BGG in conjunction with Article 73 of the Federal Code of Civil Procedure (BZP), with costs and compensation allocated per Articles 66(1)(5) BGG and Article 5(2) BZP. The motion for suspensive effect became moot.
