Legislator-Zusammenfassung
KI-generiertThe case involves a civil appeal concerning the delivery of legacies, initiated by one party against another following a decision from a lower court. The appellant challenged the lower court's ruling but later withdrew their appeal after reaching a settlement agreement with the opposing party. Consequently, the appeal was dismissed, and the court ordered the appellant to bear the legal costs associated with the case. The request for suspension of the appeal was rendered moot due to the withdrawal.

Giudice federale von Werdt, Presidente,

Oggetto
consegna di legati,
ricorso contro la sentenza emanata il 28 marzo 2013 dalla I Camera civile del Tribunale d'appello del
Cantone Ticino.
Considerando:
che con ricorso in materia civile 6 maggio 2013 A.________ ha impugnato dinanzi al Tribunale federale la sentenza emanata il 28 marzo 2013 dalla I Camera civile del Tribunale d'appello del Cantone Ticino, postulando pure la concessione dell'effetto sospensivo al gravame;
che con decreto presidenziale 8 maggio 2013 il ricorrente è stato invitato a versare un anticipo delle spese di fr. 15'000.-- entro il 24 maggio 2013, mentre l'opponente e l'autorità inferiore sono stati invitati ad esprimersi sulla domanda di conferimento dell'effetto sospensivo entro la stessa data;
che con scritto 10 maggio 2013 A.________ ha dichiarato di ritirare il ricorso in materia civile in seguito ad un accordo transattivo raggiunto tra le parti, postulando lo stralcio della procedura senza emissione di spese e la compensazione delle ripetibili;
che giusta l' art. 32 cpv. 1 LTF il Presidente della Corte dirige il procedimento quale giudice dell'istruzione fino alla pronuncia della sentenza e che in virtù dell' art. 32 cpv. 2 LTF il giudice dell'istruzione decide quale giudice unico lo stralcio dal ruolo delle cause ritirate;
che in seguito al ritiro del ricorso la domanda di effetto sospensivo diviene priva di oggetto ( art. 71 LTF in relazione con l' art. 73 cpv. 1 PC ) ed i termini per prendere posizione su quest'ultima e per versare un anticipo delle spese, impartiti con decreto presidenziale 8 maggio 2013, divengono caduchi;
che di regola le spese giudiziarie vanno poste a carico della parte che ritira il ricorso (v. decreto 5A_78/2013 del 28 marzo 2013 con rinvii);
che le spese giudiziarie, ridotte in applicazione dell' art. 66 cpv. 2 LTF , vanno quindi poste a carico del ricorrente ( art. 66 cpv. 1 LTF ; art. 71 LTF in relazione con l' art. 5 cpv. 2 PC );
che, contrariamente a quanto richiesto dal ricorrente nel suo scritto 10 maggio 2013, in concreto non si giustifica compensare le ripetibili, l'opponente non essendo in ogni modo incorso in spese della sede federale;
per questi motivi, il Presidente decreta:
