Defense Counsel Fee Assessment and Withdrawal of Appeals
Legislator-Zusammenfassung
KI-generiertDefense Counsel Fee Assessment and Withdrawal of Appeals An official defense counsel, whose professional fee was set by the lower court in a case concerning personal relations and child maintenance, filed a complaint against the cantonal decision that had dismissed as inadmissible his appeal against the fee assessment. Subsequently, the counsel withdrew the civil and subsidiary constitutional appeals filed with the Federal Supreme Court and requested that no court costs be charged. The Federal Supreme Court, in its capacity as the sole presiding judge, acknowledged the withdrawal of the appeals, ordered the case to be removed from the court docket, and imposed reduced court costs of CHF 500 on the appellant, reasoning that the expenses should be borne by the party withdrawing the appeal, but reduced due to the early stage of the procedure at the time of withdrawal.

Ritenuto in fatto e considerando in diritto:
1.
2.

art. 71 LTF in relazione con l' art. 73 PC ).
3.
