Legislator-Zusammenfassung

KI-generiert

The Swiss Federal Tribunal struck the case from the roll as moot, but ordered the appellant (the LPP supplementary institution foundation) to pay the judicial costs of CHF 500, effectively treating it as the losing party. The dispute concerned a debt-collection opposition appeal (mainlevée d'opposition) in which the appellant had obtained a final collection title after filing its appeal; the court held that the appellant’s initial mainlevée request before the cantonal judge should have been dismissed as inadmissible because the enforcement was initiated before a enforceable title existed, and the creditor should have continued the collection by a formal request to the debt collection office (art. 79 al. 1 LP). Thus, the appeal would have been rejected on the merits, and the appellant, having been the unsuccessful party, bore the costs.

Arrêt du 13 décembre 2007

IIe Cour de droit civil

MM. et Mmes les Juges Raselli, Président, Escher, Meyer, Hohl et Marazzi.

Greffière: Mme Mairot.

Parties

Fondation institution supplétive LPP,

recourante, représentée par Me Hans-Ulrich Stauffer, avocat,

X.________,

intimée.

Objet

mainlevée d'opposition,

recours contre l'arrêt de la Cour des poursuites et faillites du Tribunal cantonal du canton de Vaud du 8 mars 2007.

Vu:

le recours en matière civile interjeté le 14 juin 2007 par la Fondation institution supplétive LPP, Agence régionale de la Suisse romande, à Lausanne, représentée par Me Hans-Ulrich Stauffer, avocat, contre l'arrêt rendu le 8 mars 2007 par la Chambre des recours du Tribunal cantonal du canton de Vaud dans la cause qui divise la recourante d'avec X.________;

le plan de paiement convenu entre les parties et le retrait de l'opposition au commandement de payer de l'intimée du 20 août 2007;

la détermination de la recourante du 29 août 2007, qui conclut à ce que la cause soit radiée et les frais mis à la charge de l'intimée;

considérant:

qu'il y a lieu de statuer sur les frais en tenant compte de l'état de choses existant avant le fait qui met fin au litige ( art. 72 PCF , par renvoi de l' art. 71 LTF );

qu'étant donné que la poursuite a été introduite contre l'intimée avant que la recourante soit en possession d'un titre exécutoire;

que la débitrice y a fait opposition;

que la recourante a ensuite rendu une décision sur le fond et levé définitivement l'opposition, de sorte que sa requête de mainlevée adressée au juge cantonal de la mainlevée aurait dû être déclarée irrecevable, la poursuite devant se continuer par une réquisition de continuer la poursuite adressée à l'office des poursuites ( art. 79 al. 1 LP ; arrêt 5A_313/2007 du 13 décembre 2007);

que son recours cantonal aurait donc dû être rejeté;

que la recourante doit, par conséquent, être considérée comme la partie qui succombe;

que les frais judiciaires doivent ainsi être mis à sa charge;

par ces motifs, le Tribunal fédéral prononce:
