In this case, a debtor was pursued by a creditor for the collection of a debt amounting to 100,000 CHF. The local court initially issued a provisional ruling rejecting the debtor's opposition to the enforcement. The debtor then appealed the decision, seeking the suspension of enforcement during the appeal process, but this request was denied by the appellate court, which indicated that the appeal did not have a strong chance of success. Subsequently, the debtor filed a civil appeal to the federal tribunal, requesting the suspension of enforcement; however, it was noted during the proceedings that the appellate court had already issued a ruling on the appeal, rendering the federal case moot. Ultimately, the federal tribunal determined that the appeal had become irrelevant and decided to remove the case from its docket, assigning the associated legal costs to the debtor.

Oggetto

effetto sospensivo (rigetto dell'opposizione),

Ritenuto in fatto e considerando in diritto:

72 PC ).

Hohl Piatti
