Legislator-Zusammenfassung

KI-generiert

The case involves a company that appealed against a bankruptcy ruling issued by the Cantonal Court of Fribourg, which had rejected its request for annulment of the bankruptcy declaration. The court's decision was based on the company's failure to provide evidence of its solvency, despite prior warnings. The appeal submitted by the company did not adequately address key aspects of the Cantonal Court's reasoning and merely asserted that debts had been paid. Consequently, the appeal was deemed inadmissible, and the company was ordered to bear the judicial costs associated with the case.

Objet

faillite,

recours contre l'arrêt du Tribunal cantonal de l'État de Fribourg, IIe Cour d'appel civil, du 3 mars 2011.

Considérant:

que, par arrêt rendu le 3 mars 2011, la IIe Cour d'appel civil du Tribunal cantonal du canton de Fribourg a rejeté, dans la mesure de sa recevabilité, un recours déposé par la recourante contre le prononcé de sa faillite;

que la décision attaquée est motivée par le fait que la recourante était restée muette quant à sa solvabilité vraisemblable, condition légale permettant d'obtenir l'annulation de la faillite et sur laquelle la Cour d'appel avait expressément attiré son attention par courrier du 25 janvier 2011;

que le recours en matière civile ne correspond manifestement pas aux exigences des art. 42 al. 2 et 106 al. 2 LTF, la recourante ne s'en prenant pas aux considérants décisifs de l'arrêt cantonal et se contentant uniquement de faire valoir le paiement de la dette;

qu'en conséquence son recours est irrecevable et doit être traité selon la procédure simplifiée prévue à l' art. 108 al. 1 let. b LTF ;

que les frais judiciaires doivent être mis à la charge de la recourante ( art. 66 al. 1 LTF );

par ces motifs, la Présidente prononce:

1. Le recours est irrecevable.
