Legislator-Zusammenfassung

KI-generiert

The Swiss Federal Supreme Court struck the case from the roll due to the appellant’s voluntary withdrawal of its appeal, thereby making the challenged lower-court decision final. The dispute arose from a bankruptcy proceeding, where the appellant had sought suspensive effect against a decision of the Cantonal President of the Court of Appeals and Bankruptcy, which was the subject of the now-withdrawn federal appeal. The Court ordered the appellant to bear the judicial costs of 500 Swiss francs, applying Articles 32 para. 2 LTF and 73 PCF in conjunction with Article 71 LTF, which govern case withdrawal and cost allocation.
