The case involves a divorce proceeding initiated unilaterally by one spouse, leading to a dispute over the distribution of pension benefits accumulated during the marriage. The initial ruling by a local court determined that each spouse was entitled to half of the pension contributions made up to a certain date, while rejecting claims for a distribution of benefits accrued afterwards. An appeal was subsequently filed by the other spouse, which was dismissed by the appellate court. The party seeking to contest this ruling later brought the case to the federal court, requesting a cash payment of their share of the pension benefits to fund a new professional venture abroad. The federal court ultimately found the appeal to be inadmissible due to new claims being introduced and insufficient justification for how the previous decision violated legal standards.

Sentenza del 20 gennaio 2016

II Corte di diritto civile

Composizione

Giudice federale von Werdt, Presidente,

Cancelliera Antonini.

Partecipanti al procedimento

A.________,

ricorrente,

contro

B.________,

patrocinata dall'avv. Patrizia Casoni Delcò,

opponente.

Oggetto

divorzio su richiesta unilaterale,

ricorso contro la sentenza emanata il 26 novembre 2015 dalla I Camera civile del Tribunale d'appello del

Cantone Ticino.

Considerando:

che con giudizio di divorzio 11 ottobre 2013 il Pretore del Distretto di Lugano ha sciolto il matrimonio fra A.________ e B.________, riconoscendo tra l'altro ad ogni coniuge la metà delle prestazioni d'uscita conseguite dall'altro presso il rispettivo istituto di previdenza professionale dalla data del matrimonio fino al 30 giugno 2008, mentre ha ritenuto manifestamente iniquo e finanche abusivo qualsiasi riparto delle prestazioni maturate dopo tale data;

che con sentenza 26 novembre 2015 la I Camera civile del Tribunale d'appello del Cantone Ticino ha respinto l'appello formulato da B.________, con il quale ella chiedeva di rifiutare il riparto a metà anche degli averi previdenziali accumulati dai coniugi dalla data del matrimonio fino al 30 giugno 2008;

che con ricorso in materia civile 14 gennaio 2016 A.________ ha impugnato tale sentenza di appello dinanzi al Tribunale federale, chiedendo, per quanto sia dato di comprendere, di poter riscuotere in contanti la sua parte di previdenza professionale " per creare un'attività professionale" e " rifarsi un futuro" all'estero;

che il tema del pagamento in contanti della prestazione d'uscita non era tuttavia in discussione dinanzi all'autorità inferiore;

che il ricorrente formula pertanto una proposta di giudizio nuova che estende l'oggetto del litigio e va pertanto dichiarata inammissibile ( art. 99 cpv. 2 LTF ; sentenza 2C_1006/2014 del 24 agosto 2015 consid. 1.5 con rinvio, non pubblicato in DTF 141 I 172 );

che inoltre il gravame non spiega in che modo la sentenza qui impugnata sarebbe contraria al diritto, i vaghi accenni ad una violazione del divieto dell'arbitrio e del diritto di essere sentito essendo del tutto insufficienti;

che pertanto il ricorso, siccome esula dall'oggetto del litigio e non adempie le esigenze di motivazione degli art. 42 cpv. 2 e 106 cpv. 2 LTF, si appalesa inammissibile e può essere deciso nella procedura semplificata dell' art. 108 cpv. 1 lett. a e b LTF ;

che la domanda di assistenza giudiziaria formulata dal ricorrente va respinta per mancanza di possibilità di esito favorevole del gravame ( art. 64 cpv. 1 e 3 LTF );

che le spese giudiziarie seguono la soccombenza ( art. 66 cpv. 1 LTF );

per questi motivi, il Presidente pronuncia:

1. Il ricorso è inammissibile.
