Legislator-Zusammenfassung

KI-generiert

The case involves a person who has been placed under guardianship due to mental health issues, specifically schizophrenia, which reportedly impairs their ability to manage personal and financial affairs. The individual contested this decision through an appeal, claiming to be capable of managing their own affairs and requesting a re-assessment. However, the appeal lacked sufficient justification according to the relevant legal standards, leading to its rejection as inadmissible. Additionally, the court decided not to impose judicial costs on the individual.

Arrêt du 2 mai 2008

IIe Cour de droit civil

Composition

M. le Juge Raselli, Président.

Greffier: M. Fellay.

Parties

X.________,

recourante,

contre

Justice de paix du district de Lausanne,

intimée.

Objet

interdiction civile,

recours contre l'arrêt de la Chambre des tutelles du Tribunal cantonal du canton de Vaud du 5 février 2008.

Considérant:

que l'arrêt attaqué confirme la mise sous tutelle, prononcée le 13 septembre 2007 par la Justice de paix du district de Lausanne, de X.________ qui, à dire d'experts psychiatres, souffre d'une maladie mentale ou d'une faiblesse d'esprit au sens de l' art. 369 CC (schizophrénie), induisant dans son cas un apragmatisme qui met en péril la bonne gestion de ses affaires administratives et financières courantes et qui nécessite une aide permanente;

que dans son recours au Tribunal fédéral, la prénommée se borne à se déclarer apte à gérer elle-même ses affaires financières et administratives et à demander une contre-expertise;

qu'une telle motivation étant manifestement insuffisante au regard des art. 42 al. 2, 97 al. 1, 105 al. 2 et 106 al. 2 LTF, le recours doit être déclaré irrecevable en procédure simplifiée ( art. 108 al. 1 let. b LTF );

qu'il se justifie en l'espèce de renoncer à mettre les frais judiciaires à la charge de la recourante ( art. 66 al. 1, seconde phrase, LTF );

par ces motifs, le Président prononce:

1. Le recours est irrecevable.

Raselli Fellay
