Heirs Withdraw Appeal in Collection Proceedings After Appellant's Death
Legislator-Zusammenfassung
KI-generiertThe case involves an appeal to the Swiss Federal Tribunal regarding the definitive rejection of a challenge to an execution order by an individual against several other parties. The initial ruling by the Court of Appeals of Ticino contradicted a prior decision made by a local justice court, which had accepted the challenge. Following the appeal submitted by the deceased individual, the legal representatives of the estate later withdrew the appeal and requested suspension of the proceedings, resulting in the court acknowledging the withdrawal and striking the case from its active docket. Additionally, the court determined that the judicial costs would be borne by the appealing party.

Oggetto
rigetto definitivo dell'opposizione,
ricorso contro la sentenza emanata il 27 marzo 2017 dalla Camera di esecuzione e fallimenti del Tribunale d'appello del Cantone Ticino.
Considerando:
che con sentenza 27 marzo 2017 la Camera di esecuzione e fallimenti del Tribunale d'appello del Cantone Ticino ha, contrariamente al Pretore del Distretto di Lugano, respinto per mancanza di un titolo esecutivo quattro istanze di rigetto definitivo dell'opposizione promosse da C.A.________ contro D.A.________, E.A.________, F.A.________ e G.A.________;
che con ricorso in materia civile 6 aprile 2017 C.A.________ ha chiesto al Tribunale federale l'annullamento di tale sentenza e la conferma delle decisioni pretorili;
che con decreto 11 aprile 2017 C.A.________ è stato invitato a fornire un anticipo delle spese presunte del processo;
che con scritto 13 aprile 2017 il patrocinatore di C.A.________ ha comunicato il decesso di quest'ultimo, chiedendo la sospensione del termine per il pagamento dell'anticipo delle spese;
che con decreto 20 aprile 2017 l'invito a fornire un anticipo delle spese è stato annullato e la procedura dinanzi al Tribunale federale è stata sospesa fino al 12 luglio 2017;
che con scritto 6 luglio 2017 A.A.________ e B.A.________, " unici eredi " componenti la comunione ereditaria fu C.A.________, hanno comunicato al Tribunale federale " la revoca del ricorso del 6 aprile 2017";
che la Giudice presidente della Corte adita, competente in virtù dell' art. 32 cpv. 2 LTF , non può far altro che prendere atto del ritiro del ricorso e disporre lo stralcio della causa dai ruoli ( art. 71 LTF in relazione con l' art. 73 PC );
che le spese giudiziarie, ridotte in applicazione dell' art. 66 cpv. 2 LTF , vanno poste a carico della parte desistente, ossia della parte ricorrente ( art. 66 cpv. 1 LTF ; art. 71 LTF in relazione con l' art. 5 cpv. 2 PC ; v. decreto 5A_568/2016 del 31 gennaio 2017);
per questi motivi, la Giudice presidente decreta:
