Legislator-Zusammenfassung

KI-generiert

The case involved a civil appeal regarding the bankruptcy declaration of a company, which had been confirmed by an appellate court in Switzerland. The company contested the decision made by a local court, seeking to suspend the enforcement of the bankruptcy ruling. Following procedural requirements, the appellate court mandated the company to pay an advance on costs, which the company failed to do within the stipulated timeframe. Consequently, the Federal Tribunal deemed the appeal manifestly inadmissible due to non-compliance with conditions for consideration, resulting in the dismissal of the case and imposition of court costs on the appellant.

Sentenza del 13 maggio 2014

II Corte di diritto civile

Composizione

Partecipanti al procedimento

A.________ Sagl ,

ricorrente,

B.________ SA,

patrocinata dall'avv. Chiara Bianchetti,

opponente.

Oggetto

pronuncia del fallimento,

ricorso contro la sentenza emanata il 25 febbraio 2014 dal Vicepresidente della Camera di esecuzione e fallimenti del Tribunale d'appello del Cantone Ticino.

Considerando:

che con decisione 25 febbraio 2014 il Vicepresidente della Camera di esecuzione e fallimenti del Tribunale d'appello del Cantone Ticino ha confermato il fallimento della società A.________ Sagl pronunciato dal Pretore del Distretto di Leventina a far tempo da venerdì 21 febbraio 2014 alle ore 9.00;

che A.________ Sagl ha impugnato tale decisione al Tribunale federale con ricorso in materia civile 24 marzo 2014, chiedendo pure di conferire effetto sospensivo al suo gravame;

che con decreto 25 marzo 2014 la ricorrente è stata invitata a versare un anticipo spese di fr. 5'000.--;

che con scritto 3 aprile 2014 la ricorrente ha chiesto una proroga del termine per il pagamento dell'anticipo spese;

che con decreto 7 aprile 2014 alla ricorrente è stato concesso un termine suppletorio di dieci giorni (dalla notifica del decreto) per provvedere al versamento del predetto anticipo spese, con l'avvertenza che in assenza di pagamento entro tale termine il ricorso sarebbe stato dichiarato inammissibile;

che l'atto giudiziario contenente l'appena menzionato decreto è stato notificato alla ricorrente il 10 aprile 2014;

che il 12 maggio 2014 la Cassa del Tribunale federale ha constatato che il richiesto anticipo spese non è stato pagato né accreditato sul suo conto postale e che non le è pervenuto alcun avviso di addebito di un conto bancario o postale;

che in queste circostanze il Tribunale federale non può entrare nel merito del ricorso (art. 48 cpv. 4 e 62 cpv. 3 LTF);

che pertanto il ricorso si rivela manifestamente inammissibile e può essere deciso nella procedura semplificata dell' art. 108 cpv. 1 lett. a LTF ;

che con l'evasione del gravame l'istanza di conferimento dell'effetto sospensivo diviene priva d'oggetto;

che le spese giudiziarie seguono la soccombenza ( art. 66 cpv. 1 LTF );

che non si giustifica assegnare ripetibili all'opponente che, invitata a determinarsi sull'istanza di conferimento dell'effetto sospensivo, si è limitata ad indicare di non opporvisi;

per questi motivi, la Giudice presidente pronuncia:

1. Il ricorso è inammissibile.
