Legislator-Zusammenfassung

The case involves an individual who filed a civil and constitutional appeal regarding a claim of formal denial of justice and unjustified delay against a cantonal court. The appellant argued that the cantonal court had failed to rule on a nullity appeal submitted in August 2008 concerning a protective measures ruling from July 2008. The proceedings were deemed moot when the federal tribunal noted that it was no longer necessary to hear the case as the cantonal court had eventually made a ruling. Further, the tribunal addressed the issue of costs associated with the delay in the cantonal authority's proceedings.

Cited as the basis for ordering the Canton of Valais to pay costs (dépens) to the appellant.

Ordonnance du 12 juin 2009

IIe Cour de droit civil

Composition

Mme la Juge Hohl, Présidente.

Greffier: M. Fellay.

Parties

X.________,

recourante, représentée par Me Olivier Couchepin, avocat,

contre

Cour de cassation civile du Tribunal cantonal du canton du Valais,

Objet

déni de justice formel (mesures protectrices),

Vu:

les recours en matière civile et constitutionnel subsidiaire interjetés le 1er avril 2009 par X.________ contre la Cour de cassation civile du Tribunal cantonal valaisan pour déni de justice et retard injustifié ( art. 94 LTF ), la recourante reprochant à la juridiction cantonale de n'avoir pas encore statué, malgré ses réitérées demandes, sur un pourvoi en nullité déposé le 25 août 2008 contre un jugement de mesures protectrices de l'union conjugale rendu le 25 juillet 2008;

le jugement de la cour cantonale du 12 mai 2009 statuant sur le pourvoi en nullité précité;

l'ordonnance présidentielle du 27 mai 2009, informant la cour cantonale que la procédure de recours fédérale est devenue sans objet et l'invitant à se déterminer sur la question des frais et dépens;

la réponse de la cour cantonale du 5 juin 2009, aux termes de laquelle elle déclare n'avoir pas d'observation particulière à faire valoir;

considérant:

que la procédure de recours fédérale étant devenue sans objet, il y a lieu de rayer la cause du rôle ( art. 32 al. 2 LTF ; art. 71 LTF /72 PCF);

qu'il convient, sur la question des frais et dépens, de tenir compte du fait que le retard à statuer de l'autorité cantonale aurait conduit le Tribunal fédéral à devoir admettre le recours;

que le canton du Valais ne saurait toutefois se voir imposer des frais judiciaires ( art. 66 al. 4 LTF );

qu'il doit en revanche être astreint à verser des dépens à la recourante ( art. 68 al. 2 LTF );

par ces motifs, la Présidente ordonne:
