The Swiss Federal Supreme Court struck the case from the docket as moot and ordered the Canton of Ticino to pay the appellant CHF 1,000 in costs; no court fees were imposed. The appellant had filed a civil-law appeal for denial of justice against the lower court’s inactivity in a paternity-establishment proceeding, specifically its failure to enforce a March 2009 order for the plaintiff’s mother to produce documents and to obtain tax records. After the appellant filed the appeal, the lower court issued a new order directing the mother to produce specified documents under threat of criminal penalty and arranging direct retrieval of tax files. The Court held that, although the appeal became moot, the lower court’s delay was manifestly excessive, and had the appeal not been moot, it would have succeeded; on that basis, it applied Article 29(1) of the Federal Constitution (right to a decision within a reasonable time) and Articles 32(2), 66(4), and 68(2) of the Federal Supreme Court Act, allocating the costs to the Canton.

Oggetto

Ritenuto in fatto e considerando in diritto:

72 PC ).
