Bankruptcy Appeal Withdrawal After Failed Legal Aid and Advance Fee Payment Leads to Case Striking and Cost Shift
Legislator-Zusammenfassung
KI-generiertThe Swiss Federal Tribunal (II Civil Law Court) struck the appellant’s civil appeal from the roll after the appellant voluntarily withdrew it, thereby leaving the lower cantonal court’s bankruptcy order (pronouncement of bankruptcy) in force against the appellant (the debtor) in favor of the respondent creditor. The case involved a challenge to a bankruptcy declaration issued by the Debt Collection and Bankruptcy Office. The court took note of the withdrawal, dismissed the appeal as moot, and ordered the appellant to pay a judicial fee of 500 Swiss francs. The decision was based on procedural rules governing withdrawal of appeals (Art. 73 PCF, Art. 71 LTF, Art. 32 al. 2 LTF) and cost allocation (Art. 5 al. 2 PCF, Art. 66 al. 1 LTF).
