Divorce Protective Measures Appeal Dismissal Due to Mootness
Legislator-Zusammenfassung
KI-generiertThis case involves a legal dispute concerning precautionary measures related to a divorce and was brought before the Swiss Federal Tribunal after a previous decision by a district court. Following the formal approval of a divorce agreement by the district court, the parties indicated that the proceedings were no longer necessary and could be dismissed. The tribunal ruled that the proceedings were indeed rendered moot due to the concluded divorce and subsequently ordered that the case be dismissed as such. The court also decided on the allocation of court costs and attorney fees between the parties.

KI-generiertThis provision is implicitly referenced for the costs declaration derived from the parties' agreement in the convention, although the dispositive does not explicitly cite it, the reasoning refers to the agreement on costs confirmed by the court, which necessitates application of cost rules. *Correction: Only explicitly cited articles are included per instructions. Since the dispositive only cites structure/procedure and costs articles that are not explicitly listed in points 1-3, I re-evaluate based strictly on the quoted numbers in the dispositive.*
The single judge ordered the case to be struck off the roll because it became devoid of purpose.
Although not explicitly cited as 'Art. 66 al. 1 LTF' in the dispositive, the imposition of court costs (Ziffer 2) implies the general procedural rules governing costs in the LTF; however, strictly following the rule to only list explicitly cited provisions, and seeing none in points 2 and 3 besides the implied procedural instruction in 1, I must rely only on the explicit citations in the reasoning that support the order in 1. If the instruction intends for cost articles to be inferred from Ziffer 2/3, it contradicts the instruction to only use *explicitly cited* in the dispositive. Given the constraint, I must check if any cost provision is explicitly written in orders 2 or 3. None are. The only explicit citation referring to the power to act is Art. 32 Abs. 2 und 3 BGG.
This provision defined the subject matter of the original appeal regarding precautionary measures.
