Legislator-Zusammenfassung

KI-generiert

The case involves an individual who was deprived of their liberty for assistance purposes and placed in a clinic. After requesting a review of their situation, which cited involuntary internment, the clinic's legal commission interpreted the request as an appeal against continued hospitalization but ultimately rejected it. Subsequently, a regional administrative court annulled this decision and directed the clinic to formally decide on the review request. The individual then appealed this administrative court's ruling to the Federal Tribunal, which determined that the appeal was inadmissible as it pertained to a procedural remand rather than a substantive decision that would cause irreparable harm.

Art. 108 cpv. 1 lett. a LTF

Used to decide the appeal summarily due to its manifest inadmissibility based on procedural grounds.

Art. 93 cpv. 1 lett. b LTF

Cited in reference to the lack of demonstration that accepting the appeal would lead to an immediate final decision avoiding a lengthy procedure.

Art. 93 cpv. 1 lett. a LTF

Cited to categorize the appealed decision as an interlocutory decision that does not cause irreparable harm, justifying the rejection based on admissibility rules.

Sentenza del 25 febbraio 2009

II Corte di diritto civile

Composizione

Giudice federale Hohl, Presidente,

Cancelliere Piatti.

Parti

A.________, c/o clinica X.________,

ricorrente,

contro

Tribunale amministrativo del Cantone Ticino,

6900 Lugano.

Oggetto

privazione della libertà a scopo d'assistenza,

ricorso in materia civile contro la sentenza emanata

il 16 febbraio 2009 dal Tribunale amministrativo del Cantone Ticino.

Considerando:

che il 10 dicembre 2008 A.________ è stata privata della libertà a scopo di assistenza e collocata presso la clinica X.________;

che con scritto 13 gennaio 2009 indirizzato alla predetta clinica A.________ ha chiesto un riesame della situazione, ricordando di essere stata internata contro la sua volontà;

che la Commissione giuridica in materia di assistenza sociopsichiatrica, a cui la clinica aveva trasmesso il predetto scritto, lo ha considerato un ricorso contro il mantenimento del ricovero e lo ha respinto con decisione 23 gennaio 2009;

che con sentenza 16 febbraio 2009 il Tribunale amministrativo del Cantone Ticino ha accolto un rimedio di A.________, ha annullato la decisione della predetta Commissione e ha rinviato gli atti alla clinica X.________ affinché si pronunci con decisione formale sulla domanda di riesame;

che con ricorso 18 febbraio 2009 A.________ ha comunicato al Tribunale federale di impugnare la predetta sentenza;

che la sentenza impugnata si limita a rinviare gli atti alla prima istanza, motivo per cui è una decisione incidentale che non causa un danno irreparabile alla ricorrente, poiché ella potrà - qualora dovesse ricevere una decisione negativa - riproporre le sue censure ( art. 93 cpv. 1 lett. a LTF ; DTF 133 III 629 consid. 2.3.1);

che la ricorrente nemmeno sostiene e tanto meno dimostra che l' accoglimento del suo ricorso comporterebbe immediatamente una decisione finale consentendo di evitare una procedura probatoria defatigante o dispendiosa ( art. 93 cpv. 1 lett. b LTF ; DTF 133 III 629 consid. 2.4.2);

che in queste circostanze, non essendo dati i presupposti per impugnare una decisione incidentale notificata separatamente dal merito, il ricorso si appalesa manifestamente inammissibile e può pertanto essere deciso dalla Presidente della Corte nella procedura semplificata ( art. 108 cpv. 1 lett. a LTF );

che non si prelevano spese giudiziarie;

per questi motivi, la Presidente pronuncia:

1. Il ricorso è inammissibile.

2. Non si prelevano spese giudiziarie.

3. Comunicazione alla ricorrente e al Tribunale amministrativo del Cantone Ticino.

Losanna, 25 febbraio 2009

In nome della II Corte di diritto civile

del Tribunale federale svizzero

Hohl Piatti
