Federal Tribunal Declines Appeal on Marriage Celebration Dispute Due to Insufficient Substantiation
Legislator-Zusammenfassung
KI-generiertThe case involves an individual who filed a complaint alleging a denial of justice related to the celebration of their marriage to a Russian national. The individual contested a prior decision from the administrative court of Fribourg, claiming the refusal of the authorities to properly acknowledge and celebrate their marriage caused harm. The Federal Tribunal found the appeal to be manifestly inadmissible, as the marriage had already taken place, rendering the claim without subject matter, and stated that the individual failed to provide sufficient legal grounds challenging the relevant considerations of the earlier ruling, leading to the imposition of judicial fees on the appellant.

Arrêt du 5 mars 2009
IIe Cour de droit civil
Composition
Mme la Juge Hohl, Présidente.
Greffier: M. Fellay.
Parties
X.________,
recourant,
contre
que l'arrêt attaqué déclare manifestement irrecevable, pour autant qu'il ait un objet, un recours de X.________ dirigé contre la direction cantonale intimée et portant, premièrement, sur un prétendu déni de justice en relation avec la célébration de son mariage avec une ressortissante russe, cette procédure n'ayant plus d'objet puisque le mariage a déjà eu lieu, deuxièmement sur des conclusions en dommages-intérêts, l'action en réparation ayant été jugée irrecevable par une décision précédente, troisièmement sur la restitution ou la suppression de documents d'état civil, cette question n'ayant pas fait l'objet d'une décision;
que le recours interjeté par le prénommé auprès du Tribunal fédéral porte « sur le refus de célébrer normalement [son] mariage »;
que faute de contenir des griefs compréhensibles s'en prenant aux considérants pertinents de l'arrêt attaqué d'une façon conforme aux exigences de motivation posées par les art. 42 al. 2 et 106 al. 2 LTF, ce recours ne peut qu'être déclaré irrecevable en procédure simplifiée ( art. 108 al. 1 let. b LTF ), aux frais de son auteur ( art. 66 al. 1 LTF );
par ces motifs, vu l' art. 108 al. 1 LTF , la Présidente prononce:
1. Le recours est irrecevable.
2. Les frais judiciaires, arrêtés à 1'200 fr., sont mis à la charge du recourant.
3. Le présent arrêt est communiqué aux parties et à la Présidente de la Ière Cour administrative du Tribunal administratif du canton de Fribourg.
