Legislator-Zusammenfassung

KI-generiert

The case involves a legal challenge regarding the execution of an order for DNA testing, which is part of a paternity lawsuit initiated by a minor child through her appointed guardian. The ruling from the cantonal court, which was upheld, dismissed the mother's opposition to the DNA testing, asserting that she was not a party to the paternity proceedings and that the guardian was solely responsible for representing the child's interests. The Federal Tribunal found the mother's arguments insufficient and declared her appeal inadmissible due to lack of proper justification in accordance with legal standards. Consequently, the court ordered her to bear the judicial costs.

Arrêt du 24 février 2009

IIe Cour de droit civil

Composition

Mme la Juge Hohl, Présidente.

Greffier: M. Fellay.

Parties

X.________,

recourante,

contre

Tribunal cantonal du canton du Jura, case postale 24,

2900 Porrentruy,

Objet

exécution d'une réquisition de preuve (action en paternité),

recours contre l'arrêt de la Cour civile du Tribunal cantonal du canton du Jura du 2 février 2009.

Considérant:

que l'arrêt attaqué rejette l'opposition faite par la recourante à une décision d'exécution d'un arrêt cantonal ordonnant une expertise ADN (prélèvement de salive) dans le cadre d'un procès en paternité introduit par sa fille née en 2006, agissant par une curatrice au sens de l' art. 309 CC ;

que selon les considérants dudit arrêt, la recourante ne pouvait s'opposer à la mesure ordonnée, dès lors que seule la curatrice était chargée de représenter et défendre les intérêts de l'enfant dans la procédure en paternité;

qu'en outre, la décision d'exécution ordonnant la mesure contestée se fondait sur un arrêt cantonal définitif et exécutoire;

que de plus, la recourante, qui procédait en son propre nom, n'était ni touchée dans sa personne, ni partie au procès en paternité;

qu'au demeurant, la mesure en question avait une base légale claire ( art. 254 ch. 2 CC ) et n'impliquait aucune atteinte particulièrement grave de nature à mettre en danger la santé de l'enfant;

que devant le Tribunal fédéral la recourante se contente de déclarer son opposition au procès en paternité et à toute administration de preuves dans le cadre de celui-ci, mais ne s'en prend nullement aux considérants de la cour cantonale et ne démontre donc pas en quoi la décision de cette autorité serait contraire au droit ou à la Constitution;

qu'ainsi, faute de contenir une motivation répondant aux exigences des art. 42 al. 2 et 106 al. 2 LTF, le recours doit être déclaré irrecevable en procédure simplifiée selon l' art. 108 al. 1 let. b LTF , aux frais de son auteur ( art. 66 al. 1 LTF );

par ces motifs, la Présidente prononce:

1. Le recours est irrecevable.
