Legislator-Zusammenfassung

The case involves a public law appeal filed by an individual against a prior decision made by a civil court regarding the assessment of evidence and the potential liability of a financial institution. The civil court's ruling, which had two main arguments, found that the individual had not proven any fault on the part of the financial institution or its representatives, thereby absolving them of contractual, pre-contractual, or tortious liability regarding the individual's decision to secure her loans with collateral. The financial institution also argued that a contract signed earlier by the individual and two others had released it from any potential liability. The federal tribunal ultimately dealt with related appeals on both aspects, considering the legality of the lower court's reasoning and concluding that the public law appeal lost relevance as it targeted aspects that were not decisive to the case at hand.

Art. 108 al. 1 let. a LTF

This provision is implicitly cited as the basis for declaring the appeal without object (though the text uses the older OJ system, the modern equivalent for declaring an appeal without object due to loss of interest is typically Art. 108 LTF, but since the dispositive only lists the orders and not the procedural basis for declaring it without object, we must check the explicit citations in the dispositive. The dispositive only lists orders 1, 2, 3, 4. Since the reasoning states the appeal lost its interest, and the dispositive states 'Le recours est déclaré sans objet', we must look for the explicit citation in the dispositive. As no procedural article is explicitly cited in order 1, we move to costs.)

Art. 66 al. 1 LTF

Cited in order 2 for imposing judicial costs on the appellant.

Art. 68 al. 1 LTF

Cited in order 3 for awarding the respondent compensation for costs.

4P.7/2003

Arrêt du 26 mai 2003

Ire Cour civile

Composition

MM. et Mme les Juge Corboz, Président, Klett et Favre.

Greffier: M. Ramelet.

Parties

dame A.________,

recourante, représentée par Me Catherine Chirazi, avocate, rue de Saint-Victor 12, case postale 473, 1211 Genève 12,

contre

Banque X.________,

Vu:

le recours de droit public pour violation de l'interdiction de l'arbitraire formé par dame A.________ contre l'arrêt susmentionné;

le recours en réforme qu'elle a déposé parallèlement contre la même décision;

la réponse de l'intimée, qui conclut au rejet du recours de droit public;

vu les déterminations de l'autorité cantonale, qui se réfère aux considérants de son arrêt;

Considérant:

Que l'arrêt attaqué repose sur une double motivation;

Qu'à l'appui de la première motivation, la cour cantonale a retenu en bref qu'il n'avait pas été démontré que la défenderesse, ses organes et ses auxiliaires doivent répondre d'une faute susceptible d'engager la responsabilité contractuelle, précontractuelle ou délictuelle de l'intimée en ce qui concernait la décision prise par la demanderesse de nantir ses avoirs en garantie des fonds qu'elle a prêtés à l'association Y.________;

Qu'à titre de seconde motivation, la Cour de justice a considéré que la convention signée le 3 décembre 1999 par la demanderesse et les époux B.________ avait eu pour effet de libérer la défenderesse d'une éventuelle responsabilité, en application de l' art. 147 al. 2 CO ;

Que le Tribunal fédéral a jugé que tous les griefs du recours de droit public étaient dirigés contre des constatations de fait retenues à l'appui de la première motivation de l'autorité cantonale;

Qu'en dérogation à la règle de l' art. 57 al. 5 OJ , le Tribunal fédéral a statué sur le recours en réforme connexe avant le recours de droit public pour examiner si la seconde motivation était conforme au droit fédéral;

Que, par arrêt de ce jour, la juridiction fédérale a retenu que la seconde motivation de l'arrêt cantonal ne violait en rien le droit fédéral;

Qu'il a ainsi rejeté le recours en réforme;

Que le présent recours de droit public, qui s'en prend à des constatations qui ne sont pas décisives, a perdu son intérêt;

Qu'il est ainsi devenu sans objet;

Par ces motifs, le Tribunal fédéral prononce:

1. Le recours est déclaré sans objet.
