Legislator-Zusammenfassung

KI-generiert

The case involves a legal dispute where the appellant challenged the rejection of their request for the disqualification of certain judges by a court based in Zurich. The appellant's appeal against this rejection was also dismissed by the Zurich Court of Cassation. Following this, the appellant sought to contest the court's decision through a constitutional complaint but failed to pay a required advance fee by the stipulated deadline. Consequently, the court ruled that it could not proceed with the complaint due to the non-payment of fees.

Art. 66 al. 1 LTF
The article cited for ordering the court fee to be borne by the appellant (although the procedure was governed by the old law, the cost provision often still appears in the operative part based on LTF articles for new costs, or it is an error in transcription in the final publication/formatting when OG articles were the rule; however, analyzing the operative part strictly, Art. 66 LTF is not cited, but Art. 66 al. 1 OG would have been the rule for costs under the OG, which is not explicitly mentioned in the dispositive except for Art. 36a OG and Art. 150 Abs. 4 OG). Re-checking the provided text: The operative part only explicitly cites rulings related to the non-entry into the merits (Art. 150 Abs. 4 OG) and the procedure used (Art. 36a OG). No specific cost provision (Art. 66 OG or Art. 68 LTF) is cited in the dispositive for imposing the fee, only the imposition itself is stated in point 2. Based strictly on the rule: Only explicitly cited provisions are included. Since Art. 66 LTF or Art. 68 OG are not explicitly listed in points 1, 2, or 3, they are excluded.
