The Swiss Federal Tribunal (First Civil Law Court) did not enter into the merits of the appellant's subsidiary constitutional appeal and declared it inadmissible, thereby leaving the lower court's decision in force. The case concerned a challenge to a cantonal decision fixing attorney's fees for an officially appointed lawyer (Y.________) in a civil dispute; the appellant, X.________, had failed to pay a court cost advance within the set deadline, leading the cantonal president to deem her initial appeal withdrawn. In her federal appeal, she offered only a factual excuse (that the payment notice arrived while she was on vacation), without invoking any specific constitutional right or alleging arbitrary application of law as required. The court applied Articles 113–117 and 108(1) of the Federal Supreme Court Act (LTF), holding that the appellant's brief failed to meet the strict requirement of Article 106(2) LTF (via Article 117 LTF) to state and substantiate a constitutional violation, and thus was manifestly insufficient. The court waived judicial fees and awarded no costs to the respondent.
