In this case, a party sought to annul a previous court decision which mandated a payment of 4,500 Swiss Francs plus interest to the opposing party. The original ruling was issued by a peace judge following a petition from the opposing party, which was later upheld by the Ticino Appellate Court. The party appealing this decision filed a request for review and sought to dismiss the original petition, claiming entitlement to retained fees. However, the appeal was deemed inadmissible due to failing to meet the required thresholds for civil remedy and lacking sufficient constitutional justification for the claims made. Consequently, the appeal was rejected without further consideration.

Sentenza del 17 ottobre 2017

I Corte di diritto civile

Composizione

Giudice federale Kiss, Presidente,

Cancelliere Piatti.

Partecipanti al procedimento

A.________,

ricorrente,

contro

B.________,

opponente.

Oggetto

mandato,

ricorso contro la sentenza emanata il 24 luglio 2017

dalla Camera civile dei reclami del Tribunale d'appello del Cantone Ticino (16.2015.19).

Considerando:

che con sentenza 9 febbraio 2015 il Giudice di pace del Circolo di Paradiso ha, in accoglimento della petizione 19 ottobre 2011 di B.________, condannato la A.________ a versare all'attore fr. 4'500.--, oltre interessi;

che con sentenza 24 luglio 2017 la Camera civile dei reclami del Tribunale di appello del Cantone Ticino ha respinto il reclamo della A.________ contro il predetto giudizio;

che con ricorso 12 settembre 2017 la A.________ postula l'annullamento della sentenza cantonale, la reiezione della petizione e il riconoscimento degli onorari trattenuti;

che non è stato ordinato uno scambio di scritti;

che la sentenza impugnata non è suscettiva di un ricorso in materia civile, il valore di lite non raggiungendo la soglia prevista dall' art. 74 cpv. 1 LTF per l'inoltro di un tale rimedio di diritto, ragione per cui rimane unicamente aperta la via del ricorso sussidiario in materia costituzionale;

che con questo rimedio può solo essere censurata la violazione di diritti costituzionali ( art. 116 LTF );

che pertanto nel gravame, pena la sua inammissibilità, occorre indicare i diritti costituzionali ritenuti violati e spiegare, con un'argomentazione puntuale e precisa attinente alla sentenza impugnata, in cosa consista la pretesa violazione ( art. 106 cpv. 2 LTF richiamato dall' art. 117 LTF ; DTF 136 I 65 consid. 1.3.1; 134 II 244 consid. 2.1);

che tali requisiti non sono adempiuti nella fattispecie, poiché invano si cerca nel ricorso una qualsiasi censura - riferita ai considerandi della pronunzia impugnata - con cui viene fatta valere la violazione di un diritto costituzionale, la ricorrente limitandosi in sostanza a dilungarsi sull'attività da essa svolta e sull'agire dell'opponente;

che in queste circostanze il ricorso, manifestamente non motivato in modo sufficiente, va deciso dalla Presidente della Corte adita nella procedura semplificata (combinati art. 117 e 108 cpv. 1 lett. b LTF );

che le spese giudiziarie seguono pertanto la soccombenza ( art. 66 cpv. 1 LTF );

per questi motivi, la Presidente pronuncia:

1. Il ricorso è inammissibile.

2. Le spese giudiziarie di fr. 500.-- sono poste a carico della ricorrente.

3. Comunicazione alle parti e alla Camera civile dei reclami del Tribunale d'appello del Cantone Ticino.

Losanna, 17 ottobre 2017

del Tribunale federale svizzero
