Legislator-Zusammenfassung

KI-generiert

The case involves a provisional rejection of opposition by an individual, identified as A.________, against a debt enforcement notice issued by B.________ SA. The Justice of the Peace from the Verzasca district provisionally rejected the opposition, ordering A.________ to pay CHF 4,948 plus interest. Subsequently, A.________ filed for exemption from court fees and lodged a complaint, both of which were declared inadmissible by the Execution and Bankruptcy Chamber of the Appellate Court of the Canton of Ticino on March 11, 2024. A.________ then appealed this decision to the Swiss Federal Tribunal on April 5, 2024, seeking a subsidiary constitutional appeal, as the dispute value did not meet the threshold for a civil law appeal. However, the appeal was dismissed for not sufficiently substantiating the alleged violation of constitutional rights.

Sentenza del 14 maggio 2024

I Corte di diritto civile

Composizione

Giudice federale Kiss, Giudice presidente,

Cancelliere Piatti.

Partecipanti al procedimento

A.________,

ricorrente,

contro

B.________ SA,

opponente.

Oggetto

rigetto provvisorio dell'opposizione,

ricorso contro la sentenza emanata l'11 marzo 2024

dalla Camera di esecuzione e fallimenti del

Tribunale d'appello del Cantone Ticino (14.2023.155).

Considerando:

che il Giudice di pace del circolo della Verzasca ha, con sentenza 7 dicembre 2023, rigettato in via provvisoria per fr. 4'948.--, oltre interessi, l'opposizione interposta da A.________ al precetto esecutivo fattogli notificare dalla B.________ SA;

che con decisione dell'11 marzo 2024 la Camera di esecuzione e fallimenti del Tribunale di appello del Cantone Ticino ha dichiarato irricevibili la domanda di esenzione dal pagamento delle spese processuali e il reclamo presentati da A.________;

che con scritto 5 aprile 2024 A.________ è insorto al Tribunale federale;

che non è stato ordinato uno scambio di scritti;

che il giudizio impugnato è solo suscettivo di un ricorso sussidiario in materia costituzionale, il valore di lite non raggiungendo manifestamente la soglia di fr. 30'000.-- prevista dall' art. 74 cpv. 1 lett. b LTF per l'inoltro di un ricorso in materia civile;

che con un ricorso sussidiario in materia costituzionale può unicamente essere censurata la violazione di diritti costituzionali ( art. 116 LTF );

che pertanto nel gravame occorre indicare i diritti costituzionali ritenuti violati e spiegare, con un'argomentazione puntuale e precisa attinente alla sentenza impugnata, in cosa consista la pretesa violazione ( art. 106 cpv. 2 LTF richiamato dall' art. 117 LTF ; DTF 143 II 283 consid. 1.2.2; 136 I 65 consid. 1.3.1; 134 II 244 consid. 2.1);

che tali requisiti non sono soddisfatti nella fattispecie, poiché invano si cerca nel ricorso una qualsiasi censura riferita alla sentenza impugnata con cui viene fatta valere la violazione di un diritto costituzionale;

che pertanto il ricorso, manifestamente non motivato in modo sufficiente, si rivela inammissibile e va deciso dalla Giudice presidente della Corte adita nella procedura semplificata (combinati art. 117 e 108 cpv. 1 lett. b LTF );

che si rinuncia eccezionalmente a prelevare spese giudiziarie;

per questi motivi, la Giudice presidente pronuncia:

1. Il ricorso è inammissibile.

2. Non si prelevano spese giudiziarie.

3. Comunicazione alle parti e alla Camera di esecuzione e fallimenti del Tribunale d'appello del Cantone Ticino.

Losanna, 14 maggio 2024

In nome della I Corte di diritto civile

del Tribunale federale svizzero
